BOND HOLDERS GET INTO THE GAME
The heures for the exclusion of certain Placer County
lands from the Nevada Irrigation District got under way last
Monday but were halted Tuesday morning just as the hearing
was to commence on receipt of a telephone call froth the
bond syndicate attorneys in San Francisco who requested a
conference, which was agreed to.
The following is a resume of the points developed at the
first day’s hearing:
At the outset of ‘the
Monday, Mr. Chamberlain outlined
his position, both as a landowner in
the proposed
hearing on opinion that the Distriet as an irrigation enterprise was not practical and
that it was purely a power enterlands to be excluded prise in its conception and that its
bands against the district but gem
to see a way out.
The main point at issue at the
outset was the ruling made by the
district’s attorney that the board was
without power to issue subpoenas to
compel the attendance of unwilling
witnesses. This matter is not covered
by law and the attorneys for the petitioners for exclusion indicated that
they were prepared to go into court
to test this opinion. Mr. Eddy stated
that if the board was so impotent .
that it was without power to bring
in the full testimony that it was
high time to find it out, and that
the matters at issue are vital to the
very life of the district. That the ‘nterest of the petitioners is one of
self interest and self preservation. If
the directors are able to avoid a
land tax, that they wanted to help.
Eddy stated that he was not here
as well as the lands he. represented valuable power facilities are covered .
He stated that he has
heard that the directors had a proposition
by the Pacifie Gas und Electric con.

board where we stand.
At this point, Mr. Wisker engaged
in one of his beautiful word pietures
and ‘stated that it was a basic assumption in California irrigation districts that bonds and interest charges
would be floated by land taxes. That
45 districts in the state have a. land
tax and 40 others have water tolls,
showing 85 out of 87 distriets have
a land tax. That if the lands in
question are exctuded that they will
still be subject to the outstanding
bonds and interest: The exclusion,
however, would save them from further taxes. :
Mr. Eddy started in to puncture
, the pleasant impression: by stating
i that the Nevada Irrigation District

not basically an irrigation district
‘but it had been hoped that the po; wer revenue would plll it through.
,Eddy asked that the people be not
led away with visions tliat are visionary and in telling of the experiences

up, he was interrupted by Mr. Wisi ker who told him the board was not
interested in hearing about those
things and particularly about somiehing that had taken place elsewhere
Mr. Eddy retorted ‘ that Wisker had
started the thing with his rosy picture of other irrigation districts. After a spirited ‘intercourse, Eddy said
that if his answer to Wisker’s
statement was so hot that he could
not stand it, that he would stop but
that Wisker’s visions were drivel and
rot, and that they had to contend
with premoters and visionary people
in his district. That in the final anthat a land
tax was confiscatory. Wisker tried to
shut him. off but the board gave him
permission to conclude his statement

The attorney for the district held
that matters periaininz to the inclusion of the lands were not relevant
to the present hearing and clashes
of counsel were frequent on this {
point during the hearing. Director
Schwartz stated that he wanted to
see the petitions. Wisker said that
the inclusion could not be annulled
and Eddy said he disagreed on this
point.
At this juncture -Sheriff Carter
made a dramatic entry with a summons to-serve on the District in the '
suit instituted by Chris Hansen who :

ed that he was. to blame in their}
being included inadvertently and suggested that they be excluded for the ;
best interest of the district. He recommended an order. granting exclusion to both . the Desmond and
the Monihan tracts.
Mrs. Anna L. Dobbas, the owner
of the NW¥% in Section 12 and the
NEY in Section 16 was next sworn.
She testified that she irrigated her
holdings with water from the Caperton ditch and that as the NID is not
expecting to acquire that ditch from .
the power company that she is entitled to exclusion. Mr. Wisker 1:ecommended her exczusion. Mrs. Dobbas
said that at the time of signing she
was told that all her neighbors were
signing up and that sha might as
well come in peaceably as to be foreed in.
Mrs. Hattie F. Lewis of San Francisco, owner of land in the SW Of
Section 33, in the northwest corner
of the Placer county area, was next
sworn. She stated that her land had
always been used for grazing land .
and was using no water for arrigation although the Camp far West
ditch ran through her place. She said
she was led to belicve at the time of
signing up that she would be getting
