A Brief Record of Various Mat-} An Action to Recevera Father's Gift te His Daughter. In the Superior Court today will begin the trial of the suit entitled, Elle Ellen, by his guardian P, Henry, plaintiff, against J. L. Lewison, W. H. Kruger and George Schaffer, execntors of the estate of Emma J, Regli, deceased, defendants. The action was commenced about six month8 ago and is for the recovery of $15,000, or thereubouts, alleged to have teen an une lawfal gift of Ellen to. his daughter, Mrs. Regli, prior to the lat‘er’s death The grounds for the recovery of the sum stated are that Mr. Ellen was mentally incompetent to make a valid gift at the time the act was done, and that his daughter used andue influence over the old man. T. 3. Ford is attorney for the. plaintiff, and Fred Searls and C. F. McGlashan are the defendant’s attorneys. The case promises to be a hotly contested one and will require a week probably for its trial. Quite a number of witnesses from Truckee will be required to attend and the result will be watched for with interest. 5 The Truckee ‘Republican says “that Ellen’s condition is much the same ait has been for the past six months. He eats and sleeps well and may live an indefinite numter o2f'years. His miud and memory are badly affected and he can remember nothing fir more than a moment. He will recognize sume of his friends and the ‘moment they are out of sight will ask, “‘Who was that?” He will occasionally converse intelligently for several minutes but a_moment’s silence will. divert his mind. He seems to have forgotten the past twenty years of his life and Goes nat seem to realize that he is in Truckee, and never mentions anything in connection: with ‘he place. He has a slight recollection of his life spent in Eldorado county and sometimes mentiuns the names uf his friends of twenty-five years ago tlis is a strange case. Zellerbach Waats Another Trial, . At San Francisco Saturday two affidavits were filed in the ZellerbachAllenberg controversy upon which Zellerbach proposes to base his mition fora new trial. One of the juror, Frank T. Bruce, avers that during the trial, and while plaintiff, Zellerbach, was on the stand, Juror Rountree asked Bruce if he could not see that Zellerbach was anufacturing lies out of whole cloth. Zellerbach’s attorney also files an affidavit, in which he Says that the Deputy Sheriff took Juror Rountree from the jury-room and allowed him. to talk through a telephone for about fifteen minutes, and that after his return the jurors A.
