, Stitution. ane t . Che Daily Transcript. f SUNDAY, DEO. 2, 1888. EE A Reliable Remedy. Coughs,-colds, sore throat and other like difficulties are now prevalent and will be during the entire winter. Among the scores of remedies for these ailments that are offered in the market, none has been found so thoroughly effectual and agreeuble as Miss Hannah Branch’s Great English Remedy, as it is called. This preparation is the invention of a Nevada county lady, and is compounded from harmless herbs. There is nothing in it injurious 'o the most delicate. conIt is rapidly supplanting other medicines of the kind whereever it has been introduced, as none who have used it once will be without it. The Latest Social Fads. The “‘corn festival and crazy tea’’ is the latest invention of the ladies: for swelling the exchequers of churches, aid societies and the like. The tables are decorated with huge pumpkins, onions and corn on the cob, while the lady waiters wear‘necklaces of popped corn, and festoons of the same in their , hair and about their persons. The refreshments are arranged in ridiculous fashion, to carry out the crazy idea, Cake is passed in small cullenders, butter occupies dishes several times too large, and everything is served on the same plan. The Chautauquans Organize. A meeting was held Friday evening at the residence of Mrs. V. S. Bradley for the purpose of organizing Hellas Circle, C. L. 8. C., fur the term of 1888-89. The following were elected as officers: E. M. Preston, President; F. T. Nilon and Mrs.L. S. Calkins, PIONEER JUSTICE, ky A Fallacy Exploded—A Barren Hole in the Ground, I noticed in a Bay paper a few days since an account of the earlier days in the mines, and especially in those of Nevada county. The article on the whole was cofrect enough for tlte casual reader, but as there will be atime when the history of the daya and deeds of the modern argonauts, their habits and customs, and their peculiar civilization, wilt be of interest, and should be correct and reliable, it will be evident to most people that the authority should rest on some firmer basis than the gossip of Mrs. Grundy or the extravagances of simple tradition. It is plain the writer spoke from hearsay, and was not an actor in the drama. This subscriber being one of the first pioneers of the county does not remember when there was such: an office as the so-called Alcalde. It is true, there was such in San Francisco. It arose during the Spanish or Mexican occupation, and was contemporaneous with and natural to the days when. that place was known to the natives’ as Yerba Buena, The derivation of the word Alcalde does no! seem to be generally understood. I is of Arabic or Moorish origin, and ia corruption of El Cadi, the judge. It came to Spain with the Moorish invaders, and may date from the occupation of Cordova and the time of the Alhambra. It is purely Mohammedan in its location, being authority in both civil and sacerdotal law. ‘The judge or Cadi has or had the power to punish an omission to pray at the stated hour, or to turn the face of the believer towards Mecca, in the same mauner as he would punish theft. A the Koran was the foundution of law as well-as doctrine, Alcalde. is _oneo the worst corruptions conceivable. I ‘ments of rifle with him; to not come back unless unarmed ; that justice and equity were on my side. The hole had nothing in it, everything having boiled out by the the force of the torrent that made it. I was out $1,100, and have prospected no more hules of that kind. W. K. Weare. Nevapa City, Decémber Ist, 1888. The Hecount Cases. The demand for a recount of the election returns in this county made by Messrs. Lord and Rapp continues to be a topic of much talk and no little controversy. The Tidings says of it: “The Tidings has interviewed the election officials of Boston Ravine and Hill’s Flat precincts. Eachand everyone spoken to vehemently denied the allegations of irregularities and malconduct made by Sheriff Lord and Recorder Rapp, and assert that the recount will stultify the sworn sta'ethe contestants. These officers are highly indignant that they should be directly or by intimation accused of fraud and are supported by their friends. Much ill-feeling has already been engendered and it is proposed not to let the matter drop with the recount. On the other hand, Sheriff Lord is quoted as saying he will prove his allegations.” en The Grass Valley Union of yesterday says: *©“These pro.eedings have caused much bitterness of feeling on the part of the officers of election and residents of Hill’s Flat and Boston Ravine precincts, who say that there are no zrounds for these affidavits—that the election was fairly conducted and the votes fairly counted in the presence of 1 large number of citizens of both parties who were present and watched the proceedings. Itis not unlikely that these affidavits may furnish the basis uf several suits for libel.”’ = Breakers Ahead. PERSONAL MENTION. EA — Secial and Other Notes Abqut People Oldand Young. — L. As regards the offive or positior under that name; it did not “obtain in the purely English mining districts and not here. Old Zeke Docherty might have made a thief return the gold dust tothe miner he stole it from. and pay the expenses of the court, and he might have charged sixteen dollar: to the complainant for making a fuss and taking up the time, the valuable time,of the court, and sentence him ti ‘thirty-nine lashes well laid on.’? Hi was capable of it, but any man who dared to call him an Alcalde instead of Judge Docherty, thereby confounding him with a Greaser, would have been likely to have received a more severe sentence. In the early days outside of thir city, and here also, before the officer of District Attorney and Sheriff were “inaugurated, eqnity was the code ant artitration the practice. A man was tried or a title toa mining claim was pronounced valid or otherwise by a real tribunal of peers, as the men were chosen from the persons present. No collusion could occur. Each party chose his man alternately from the materiul in sight. In case a party was dissatisfied with three arbitrators, five were allowed, and in the extreme seven. Claims of great value were settled in that manner, and it is notable that any appeal to the jurisdiction of the
law subsequently almost. invariably confirmed such decisions. . There always were, and it is fair to presume that there always will be, men who will not sacrifice their interest to the right from any love of fairness or honor. The writer had an exper ience: of that kind in 1852. At the suggestion of Frazer McLeod and some others I purchased a claim from a Canadian named Louis Guyor, the claim being ariver claim situated on, Frenchman’s Bar on the South Yuba river. When bought it was not workable, being in the winter, and that kind of business was a lottery practically. I paid $250. On the claim was a deep hole, a mimic lake, and I labored in the prevalent delnsion that the bottom of that was full of gold. I was not alone in the mistake, a mistake which experience made ridiculous. We did not at that time consult either logic formation or geology. We did not go back to causes. We did not swap ‘‘juck-knives.”” When I went there to work the claim \one John Lafitte denied the title of Guyor, and consequently mine. I proposed an arbitration. He refused. He would have law. It was a subterfuge to gain time and freeze me out. I knewit. Sol went to Dutchman’s Bar above and to another. Bar below, the latter bearing a euphenious name of the kind fashionable then if not now, and represented my case, requesting their presence to arbitrate and decide. They came toa@man, of course. I had to be hospitable at Blackhawk’s saloon, (Mr. Garthe of this city will remember it.) Lafitte refused to attend the conference, and it decided in my favor. On the morrow Lafitte mounted a large boulder which was centrally located on the claim. Armed with a rifle he asserted‘that he would shoot any one who stuck a pick in the ground. I have no doubt that there was not a man who had not more physical courage than myself. Iam sure my partner Yates did; but none wished togo. The men who decided in my favor sat on the bank all armed. Lafitte was notafool. I knew that the moment he would raise t! e rifle he would be riddled with bullets. It did not require courage. I went close to him and commenced to dig. He never raised the weapon. I then told him to leave the claim and take his There is blood upon the mercantile moon.
