The bill is unfair, especially to the smaller counties of the state which have only one regular judge, The challenge, if exercised indiscriminately, would materially increase litigation costs. . This proposal is made to remedy a condition where, it is claimed; certain judges are biased and prejudiced. Both such conditions: prevail in not more than two or three counties in the entire state and this bill would upon every county of the state. By implication it inpugns the integrity of the en'tire judiciary. AcSpotlighted by flashes of startling evidence, there's a black cloud of rumor spreading over the state to the effect that radicals are taking advantage of the California relief situation to force SRA and WPA workers to join red-dominated labor groups. ‘At Long Beach, 40 union men struck on a WPA building project because the subcontractor had refused to sign a contract requiring his men to take out union cards—despite the fact that the two non-union men over whom the dispute arose, an ornamental iron worker and helper, were receiving the regular WPA scale of $1.25 and 75 cents an hour, respectively. clares that “the communistic Workers’ Alliance, CIO and other radical organizations have taken almost complete. control of the SRA, WPA and other relief agencies and are now waxing fat at the public trough at taxpayers’ expense!’ And in Sacramento, where he is spokesman in a fight to prevent imposition of increases in the state tax load, which has contributed to heavy casualties of mortgage-ruin farm and small-home owners, William A. Then, at the last minute, he can ob‘tain a postponement of the trial and oust the judge from ‘jurisdiction by merely filing his affidavit that he believes he cannot have a fair trial. He need not state any facts whatsoever. The bill will entail expensive delays, and postponements in the trials of both civil and criminal cases. In so far as it aiffects criminal cases it will impose great financial burdens on the counties by reason of the fact that witnesses who are subpoenaed for the date set for trial will have to be excused to another date and their witnesses fees will have to be paid. The law now gives sufficient protection by providing for the dis+ qualification of judges when it can be shown that the judge is biased and .prejudiced. The bill, I believe, is unwise and unnecessary.
