SUBCRIPTION RATES THE NATIVE SONS The Native Sons, meeting for their annual Grand Parlor in Grass Valley today, are weleome guests on the Mother Lode and in this County of premier gold production. Probably three fourths of the four hundred or more delegates, are des-. cendants of or related to the Argonauts who founded here the cities of Nevada City and Grass Valley. Their convention is in the nature, then, of a home coming, a visiting the hearths and the homes where so many of their grand parents wreste the gold from these hills. * For all those who visit these two cities the traditional hand of hospitality, the warm, kind welcome of the pioneers, is extended, but especially cordial is the greetings to these Sons of California whose coming is more of a return than a visit. Tablets here and there along the highway of the Mother Lode, bear witness to one of the splendid activities of Native Sons and Daughters. The people of the state, millions of them coming originally from other states, are learning its splendid history, and these commemorative tablets, beautifully molded and cast in bronz, are in the nature of shrines, before which motorists often halt to read the legend and pay tribute to the memory of the rugged and virile founders of California. Since the Native Sons and Daughters began their endeavors to make the: people of this state history conscious, proud of its great traditions, of its early poets and novelists, its explorers and its jurists, in short, proud of all those leaders in thought or action, who left their stamp indelibly upon the social fabric, thousands not born in the Golden State, have been inspired to hand on the torch. Our State University through the practical assistance of funds for more than twenty years has offered instruction in California history. A great library of early California documentary history, some of it purchased from Spain and Mexico, has been gathered at the State University and researchers in California history have been able to throw new light on many matters of importance in world history through the study of these documents. We should be very remiss if we failed to mention here another splendid activity of. the Native Sons and Daughters. That is their home finding bureau for children. The elder California Sons and Daughters have evinced a great tenderness for all those tiny, new sons and daughters that every year are born unwelcomed or, through parental misfortune, are cast adrift. These abandoned waifs, through the long years have gladdened many a childless home in California. For them the Native Sons and Daughters have found warm and hungry hearts to take them in, rear them and educate them to fine citizenship. In these two endeavors the Native Sons and Daughters are building up in California imponderable and intangible human values for all time. Though they cannot be weighed and cannot be sensed in the ordinary way, they constitute, nevertheless, an empire of spiritual riches in a world too much given to material things. ORDINANCE AUTHORIZING THE CITY COUNCIL OF THE CITY OF NEVADA TO LICENSE AND REGULATE THE SALE AND DISPOSITION OF BEVERAGES CONTAINING ALCOHOL, AND TO PROVIDE PENALTIES FOR THE VIOLATION THEREOF: The City. Council of the City of Nevada, do ordain as follows: SECTION 1: As‘used in this Ordinance: é (a) “Aleoholic beverage”’’ or “beverage” meats any beer, ale, porter, wine, similar fermented malt or vinous liquor or fruit juice containing one half (%)} of ome (1) per centum or more of alcohol by volnot more than three and two-tenths (3.2) per centum of alcohol by weight which are fit for beverage purposes. (b) -=“Packaze’”’ or “original package’ means any container or receptacle used for holding or containing alcoholie beverages, which container or receptacle is corked or sealed: ‘‘Corked’’ or ‘‘sealed’’ means closed with any stub, stopper or cap, whether made of cork, wood, glass or metal, and labeled and sealed as is prescribed by the laws and regulations of the United StateS of America and of the State of California. (ec) “On sale licenses’’ means a license to sell aleoholic beverages for consumption only on the prem-} ises in respect to Which the license is issued. { 1 (d) “Off sale license,’” means a license to se] alcoholic beverages in original packages for eonsumption only off the premises im respect to which the license is issued. (e) “To sel” or “‘sate’’ and inciudes any of the -following: to sell; to exchange or barter; to keep, offer or expose for sale; to serve with meals whieh are served for any consideration; to traffie in for any consideration promised or obigined; directly or indirectly. (f) “Persons’’ means and includes any natural person, partner-. ship, corporation and association. SECTION 2: On sale licenses shall be granted only to hotels boarding’ houses; restaurants, cafes, cafeterias _and other public eating places, where meals are furnished in good faith to the guests and patrons thereof. Off sale licenses may, in the discretion of the City Council be means granted to holders of an on gale liSECTION 3: The holder of an on sale license shall not sell any alcoholic beverage under such licenses except when the same is to be served and consumed with meals furnished in good faith to the guests and patrons of such licensee. SECTION 4: All licenses issued hereunder shall be granted by the City Council of the City of Nevada. SECTION 5: Applications for a license hereunder shall be filed with the Clerk of the City of Neyada on forms provided by the City Council, which application shall designate whether an on sale or off sale license is desired, and such additional information as may be prescribed by resolution of the City Council and this ordinance. Each application shall be accompanied by the license fee hereinafter provided. SECTION 6: Upon the receipt of an application for a license hereunder and the license fee herein provided, the City Council must thordughly investigate the Same and must deny the application Sis (a) The applicant is not a fit ind suitable: person to -sell alcoholic veverages; (b) The premises and equipment or the plans thereof, in respect to which the license is to be issued are not proper and suitable for public use or do not comply with the Provisions of the sanitation laws, the_provisions of this ordinance, or the rules and regulations of the licensing board; : (c) The applicant has had a license forfeited, suspended or revoked under the Provisions of this ordinance; (d) If the applicant, subsequent to the passage of this ordinance, and Within one year prior to the filing of. his application, has been convicted of a violation of any law conc¢éerning the manufacture, transportation, or sale of liquor, or has been convigted of a felony under any law; (e) The applicant is not of good moral character; (Mots the epinion Couuz.i, the sranting of such license is rot cenvistent with the public welfare. SECTION 8: Every license issued under this ordinance shall get forth the name of the person to whom it is issued. the names of each member of a partnership, and the-+ names of the officers of a corporation, if issued to a Partnership or corporation, and the location of the premises in respect to which -the license is issued. SECTION 9: No license shall be granted to any applicant who fails. to comply with the Provisions of this ordinance and may be refused if the applicant has not been a resident of the City ‘of Nevada for a period oz one year prior to the Gate of making application. SECTION 10: Each license shall be. signed by the licensee, shall be non-transferrable, shall beposted in 4 conspicious place on the premises In respect to Which it was. issued and shall be exhibited to any representative or member of the City Council, or any peace officer whenever requested. SECTION 11: Each license issued hereunder shall be separate and distinct, and a separate license shall be issued for each Specific business and for each location, and each license shall be applicable only to the . premises in respect to which it is issued. The City Council Shall determine what constitutes a_ specific business, premises: or location with respect to the issuance of any license hereunder and its decision shall be conclusive. No license ghall be used-or exercised in respect to any other premises than the premises for which it is issued. SECTION 12: Upon the granting of the license by the City the apfot NEVADA CITY NUGGET OF the City)! © ee City of Nevada a license fee of Ten Dollars ($10.00) per annum, or portion thereof, for each off sale, and Twelve and 50. 100 Dollars ($12.50) per quarter, or portion thereof, for each on sale license. The clerk of the City Council shall prepare and have printed appropriate blank licenses and shall sign’ and affix the official seal of the City Council. ae All off sale licenses shall expire on the 31st day of December of each year, and all on sale licenses shall expire on the last day of each quarter. { SECTION 13: For the purpose of this ordinance, each year shall begin on the first day of January and shall be divided in quarters of three calendar months each. » SECTION 14: The holder of any valid, unrevoked off sale license may renew the same for the’ ensuing year by paying the annual license at any time within thirty (30) days prior to the expiration of the current year, and the holder of any valid, unrevoked on sale license may renew the same for the ensuing quarter, by paying the quarterly fee at any time within ten (10) days prior to the expiration of the current quarter. Such renewal license shall be issued in the same manner as provided for the issuance of the first license, but without any action on the part of the City Council. SECTION 15: The. licensing ; board may, upon its own motion and shall upon the verified complaint in writing of any person, investigate the action of any licensee and shall have power: to temporarily suspend or permanently revoke a license issued hereunder for any of the following acts or omissions: (a) .Misrepresentation of a material fact by the applicant in. obtaining a license. (b) If the licensee violates o. causes' or permits to be violated any of the provisions of this ordinance
or any of the rules and regulations of the licensing board whether adpoted before or after the license is issued; or (¢) If the licensee commits any act which under Section 6 of this ordinance would be sufficient grounds for the denial of an application for a license. (d) If in the opinion of the City Council the continuance of the exercise of such li¢ense is not consistent With the public welfare. SECTION 16: Prior to the revocation of any license issued here under by the City Council, ten (10) days’ notice shall be given to the licensee by personal service or by registered mail directed~to the licensee at the place of business designated in the license. Licenses shall be revoked by the City Council only upon notice as provided herein and upon a hearing at which the licenS€e many attend and be heard. The revocation of any license issued hereunder by the City Council, after such notice and hearing, shall be final and conclusive. SECTION 17: No brewer, manufacturer, producer or wholesale distributor -of alcoholic beverages shall sell any such beverage to any person for retail sale other than to a person holding a valid, unsuspended, unrevoked license under the provisions of this ordinance. SECTION 18: No person shall sell any alcoholic beverage without holding a valid, unrevoked, unsuspended license as herein provided. SECTION 19: No person shall sell any alcoholic beverages between the hours of one’ o’clock a. m. and six o’clock a. m. on any one day. SECTION 20: No person shall sell any alcoholic beverage to any minor under nineteen (19) years: of age. SECTION 21: ‘This ordinance shall not apply to the sale of beverages containing more than 3.2 per cent of alcohol by weight by pharmacies and drug stores for medicinal . purposes on the prescription of a . physician, surgeon or other duly licensed prescriber. f SECTION 22: Nothing herein contained shall be construed to prevent the bona fide employees, of any licensee hereunder from assisting him in the sale of alcoholic bever. ages on the premises with respect to . which his license is issued. The biggest majority of these children are to enter grammar school in the fall with some to enter at'a later date and a few were re-checked. Dr, Stadmuller, -of the department of Child Health of the state, examined the children. any lincesee or of any of his employees operating under such license, of a violation of this ordinance, shall automatically revoke such license. SECTION © 25: If any section, sub-section, sentence, clause _or phrase of this ordinance is for any reason held:to be unconstitutional or invalid ,such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each section, sub-section, sentence, clause or phrase thereof irrespective of the-fact that One or-more of the sections, sub-sections, sentences, clauses or phrases thereof be declared unconstitutional or invalid. = SECTION 26: This ordinance shall-be known as the Alcoholic Beverage Ordinance. SECTION 27: Any ordinances or parts thereof, of the City of Nevada, in conflict with the provisions of this ordinance are hereby expressly repealed.
