J. D. Kelley wasconvieted of man
slaughter at Downieville last week-}for the killing of a codk known as.
“Frenchy” at Loyalton last August.
Kelley and the deceased became engaged in an altercation over a ganie of
cards, both being under the infiuence
of liquor, and Kelly struck the mar
over the head with a crib-board. He
died from the effects of the blow
several days after. Kelley was sentenced tofour years in the State Prison.

might otherwise be subjected. So she
made up her mind that she would become an interesting widow also, if
the thing could be managed, .
Accordingly she began to lay her
plans, and returning to Oakland took
up her residence in the Henry House,
where she met Mr. and Mrs. R. M.
Apgar. Mr. Apgar was consulted
and agreed that ifshe was determined
to marry at all hazards, «and for the
purpose stated, it would be advisable
to have the thing settled with as little
publicity as possible. He accordingly
introduced this peculiar young lidy to
Dr. Anson A. de Puy" He declared
that he knew of just the man to~stit
Miss Frankie’s wish, in the person-of
a poor printer named Frank McKee,
who had a beautiful case’ of -consumption, with a blood-spitting accom paniment, and whocould not possibly live
more than one month, or say six
weeks at the outside. Accordingly,
on the following day, December 27th,
she and Mr, Apgar went to the office
of Dr. De Puy where the medical man
exhibited his consumptive. Miss
Frankie looked at him with a critical
eye, thumped his chest vigorously,
and mada him cough several times for
the purpose of seeing if the investment wasa safe one. She tinally conéluded thatshe would tuke the chances of his living. MeKeo had mean
while been informed of the peculiar
arrangement and consented to marry

ation. The pair were at onee wedded
by Justice Wood. ‘They did not depart
together, however. [t had been azreod
that the husband should yo and die by
himself, and thus quictly and expeditiously settle everything in a satisfactory manner. ‘The wife gave him $100
before the ceremony took place, and
agreed to pay Dr, De Puy $700 with
which to defray the expenses of a
comfortable death bed for her husband.
McKee failed to keep his promise,
however, and strangely insisted on
living. In fact, he grew alarmingly
healthy, and evidently thought he had
what is vulgarly termed ‘‘a soft snap.’’
Mr. McKee did not see her again until
February. She tcld him she had been
looking for him and that she had sent
him money at different times, in all
amounting to $500. McKee replied
that he had received $80 of this sain,
Mrs. McKee then made an appointment to meet her husband a few days
later, which she kept. The couple
took a drive through the Park, when
the wife, so McKee subsequently
stated, proposed that they should
live as man and wife. He did not at
once accept the proposition and his
wife thereupon became piqued at
his coolness. He declared that she
said that she was wi.ling to support
him and desired him to fx a monthly
sum on which he could live, but he refused to do so, through ‘delicacy,’
After that Mrs. McKee becanie economical and failed to give her husband
any more cash. Early last summer
she went East and visited friends at
some point in Indiana. Her ausbanid
followed and attempted to obtain an
interview with her, but she refused to
see hiin. Then the wiie went to
Europe, accompanied by Mrs. Jolin
Hamilton of this city. She has not
yet returned.
