CONSTUCT, MAINTAIN AND OPERATE IN SAID PUBLIC STREETS, WAYS AND PLACES ALL MAINS, PIPES, CONDUITS AND CONNECTIONS, NECESSARY OR PROPER FOR SAID PURPOSWHEREAS PACIFIC. GAS AND ELECTRIC COMPANY, a California utility corporation, has filed with the Council of the City of Nevada an application requesting that a franchise be Branted for the purposes . mentioned in the title to this resolution; and ‘prior to its amendment on October WHEREAS in the opinion of this Council the public good requires that said franchise be granted; NOW, SOLVED by the Council of the City of Nevada that said Council intends to grant said franchise by the adoption of an ordinance in the form thereof which is set forth in the notice hereinafter ordered to be pub. lished; that a time and place be and the same are hereby set for receiving bids for said franchise, that the franchise be struck off, sold and awarded to the highest bidder and that a bond be required of the suceessful bidder therefor, all as set forth in the form of notice herein contained, and that the Clerk of said city be and he hereby is directed to publish once a week for four (4) successive weeks in Nevada _ City Nugget, a weekly newspaper published in said city, a notice of said application and of the time and place fixed for receiving said bids, in the following form: ° “NOTICE OF SALE OF FRANCHISE NOTICE IS HEREBY GIVEN that on the 5th day of November, 1936, an. application in writing was filed with the Council of the City of Nevada, State of California, by Pacific Gas and Electric Company, a California. utility corporation, requesting said council to grant a franchise (a) to use, for transmitting, conducting and distributing gas within the City of Nevada for any and all W. PIPES, CONDUITS AND CONNEC. . ithe granting of the’ franchise herepurposes other than those authorized under Section 19 of Artile XI of the Constitution of the State of California as said section existed 10, 1911, all gas mains, pipes, conduits and connections therewith thaz are now or may hereafter be lawfully placed in the public streets, ways and places within said city, and (b) to construct, maintain and operate in said public streets, ways and places all mains, pipes, conduits and connections necessary or proper for said purposes; that said council proposes to grant said franchise by ordinance which shall be in the following words and figures, namely: ‘acer nan ras 1 ~» ORDINANCE NO. —— ORDINANCE GRANTING TO , ITS SUCCESSORS AND ASSIGNS, THE FRANCHISE TO USE, FOR TRANSMETTING, CONDUCTING AND DISTRIBUTING GAS WITHIN THE CITY OF NEVADA FOR ANY AND ALL PURPOSES OTHER THAN THOSE AUTHORIZED UNDER SECTION 19 OF ARTICLE XI OF THE .CONTITUTION . OF THE STATE OF CALIFORNIA AS SAID SECTION EXISTED PRIOR TO ITS AMENDMENT, ON OCTOBER 10, 1911, ALL GAS MAINS, PIPES, CONDUITS AND CONNECTIONS THEREWITH THAT ARE NOW OR MAY HEREAFTER BE LAWFULLY PLACED IN THE PUBLIC STREETS, WAYS ANDPLACES WITHIN SAID. CITY, AND TO CONSTRUCT, MAINTAIN AND OPERATE IN SAID PUBLIC: STREETS, WAYS AND PLACES ALL MAINS, TIONS NECESSARY OR PROPER FOR SAID PURPOSES. WHEREAS this ordinance and any other proceedings in connection with in provided for shall not be considered or construed to be a release of, a waiver of, or in derogation of the rights and privileges that the grantee hereunder now owns of. using the public streets and thoroughfares of said City of Nevada and of laying down and using gas mains, pipes and conduits therein and connections therewith under and pursuant to the provisions of Section 19 of Article XI of ‘the Constitution of the State of California: as the same’ existed prior to its amendment on October 10, 1911, NOW, THEREFORH, The City Council of the City of Nevada do ordain as follows: Section 1. The franchise (a) to use, for transmitting, conducting and distributing gas within the Cit» of Nevada for any and all purposes other than those authorized under Section 19 of Article XI of the Cay stitution of the State of California as said section existed prior to its amendment on October 10, 1911, all cas mains, pipes, conduits and connections therewith that are now or may hereafter be lawfully placed in the public streets, ways and places within said city, and (b) to construct, maintain and operate in said public streets, ways and places all mains, pipes, conduits and connecsions necessary or proper for said purposes is hereby granted to , its successors and assigns, for the term of fifty years from and after theeffective.date.of this ordinance upon the terms and conditions in this ordinance prescribed. Section 2.° All construction done under said franchise shall be done subject to the general supervision and direction of the proper authorities of said city and in compliance with all valid ordinances and regulations which are now or shall hereafter be enacted and prescribed by said city under its police power. Section 3. All public — streets, ways or places disturbed or excavated by grantee, its successors or assigns, hereunder, shall at its or their own cost and expense immediately be placed in as good order and condition as same were in before being so disturbed or excavated. ! Section 4. The grantee of. said franchise, its successors or assigns, shall during the life of said franchise pay to said city two per. cent (2%) of the gross annual receipts of said grantee, its successors or assigns, arising from. the use, operation or possession of said franchise. No percentage shall be paid for the : ° first five years succeeding the date of this franchise but,thereafter such percentage shall be payable annually; and in the event said payment shall not be made said _ franchise shall be forfeited; provided, however, that if said franchise be a renewal of a right already in existence the payment of said percentage of}. gross receipts shall begin at once. Section 5. This ordinance its final passage, unless suspended by a referendum petition filed as} provided by law. Section 6. This ordinance shall be published once within twenty days after its final passage. in Nevada City Nugget a newspaper of general circulation published and circulated in said city.’; and ‘ NOTICE IS, HEREBY FURTHER GIVEN that sealed bids for franchise will be received by ‘said council at the office of the City Clerk of said city up to the hour of 8 p.m. on Wednesday, the 23rd day of December, 1936; that said council will meet in open session in the. City Hall in said city on the day and at the hour last hereinbefore mentioned, and will then and ‘there open and read such bids; and then and there strike off, sell and award said franchise to’ the verson, firm or corporation that shall make the highest cash bid therefore, provided shall}, become effective thirty: days after . ’ such . . only, that at the time of the open-. . ing of said bids any responsible per. ’ son, firm or corporation present of . . . represented may bid for such fran:}}-— ding may so continue until finally said franchise shall’ be struck off, sold and awarded by said council to the highest bidder therefor, as provided ‘by law; that each sealed bid shall be-accompanied with cash or
a certified check payable to the treasurer of said city for the full amount of said bid, and no sealed bid shall ‘be considered unless such cash or certified check shall be enclosed therewith, and the successful bidder shall deposit at least ten per cent of the amount of his’ bid with the Clerk of said city before said franchise shall be struck off to him and if he shall fail to make such deposit immediately his bid shall not be received, but shall be considered as Yoid, and. said franchise shall then and thére be again offered fot sale to the bdder who shali make the highest cash bid therefor, subject to the: same conditions as to deposit as above mentioned; that such procedure shadd be had until said franchise shall be struck off, sold and awarded to the bidder who shall make. the’ necessary deposit of ten (10) per cent of the amount of his bid as heréinbefore provided; that such successful bidder shall deposit with the Clerk of said city the acceptance of his bid the remaining ninet (90) per» cent of the amount thereof, and in case he shall fai? to do so, then said deposit theretofore made shall be forfeited and the award of said franchise shall be void and said franchise shall then and there by said council be again offered for sale to the highest bidder therefor, in the same manner and under the same restrictions as hereinbefore provided, and _ in case said bidder shadi fail to deposit with the Clerk of said city the remaining ninety (90) per cent of his bid within twenty-four (24) hours after its acceptance, the award to him of said franchise shall be set aside! and the deposit theretofore made by him shall be forfeited, and no further proceedings in the sale of seid franchise shall be had unless the same shall be again advertised and offered for sale in the manner hereinbefore provided; and NOTICE IS HEREBY FURTHER GIVEN that the grantee of said franchise must within five (5) days after the same shall have been awarded, file with said Council a bond running to said City of Nevada with at least two (2) good and sufficient sureties to be approved by said council in the penal sum of one thousand dollars ($1000.00), conditioned that such bidder shall well and truly. observe, fulfill and perform each and every term and.condition of said franchise, and that in case of any breach of condition of said bond the whole amount of the penal sum therein named shall be taken and deemed to be liquidated damages and shall be recoverable from the principal and sureties upon said bond; and that in case said bond shall not be filed as aforesaid, then the award of said franchise shall be set aside and any money paid therefor shall be forfeited, and said franchise shall, in the discretion of said council,’ be readvetised and again offered for sale as provided by law. For further particulars reference is hereby made _ to said application filed as _aforesaid in the office of said council, and also to the resolution adopted by said council on the 5th day of November, 1936,. declaring its intention to grant said franchise.
