After a summer of rest, nine venerable gentlemen, blackrobed and solemn, are back in the sanctum of the Supreme
Court of the United States, brewing the broth of some
momentous headlines of tomorrow. cane
There will-be-decisions during this eight-month session
that will influence the charting of the whole future course of
America’s voyage through time on the good ship Constitution.Now that the Court is again in session, renewed public
goncern over constitutionalitly is pertinent in California. At
least’one law before the people of this state in the coming
election, if it passes, will quite possibly”face a test in Court.
Most opinions hold it is unconstitutional.
We refer to the much discussed and intensely controversial Chain Store Tax, passed by the last legislature as the “Retail Store License’’ and now on the Nevember ballot for referendum vote.
Most obvious of this #w's unconstitutional features are
its arbitrary exemptions. It says al! chains must pay a\$500
tax on each store over nine, except (and it enumerates )chain
gas stations, chain theatres, chain. restaurants on commoncarrier, and chain ice stores. \
That is like a personal tax exempting everyone with blue
eyes or brown hair, a tax which no court, of course, would
uphold. “
There are people, we suppose, who have no objection
to beosted prices, to using the tax.power as a weapon against
a business, or who are not aware that once so used, it might
hit them some day. Perhaps at least such persons, out of respect for the Constitution, will have compunctions about putting a palpably unconstitutional act on the lawbooks of California. Zs
In any“case, as the Supreme Court takes the spotlight
again, wé of California might do well to give constitutionality
an extra thought. We'll be a veritable Supreme Court ourselves on November 3.
Japan And Our Future — i

A sharp warning to Japan that the United States will
_match her, fort for. fort, if she starts a fortifications race in
' the Pacific, crackled out of Washington last week.
While it may have sounded unduly belligerent, the purpose of the warning was, of course, to prevent such a race. Japan has already indicated that she will balk at renewal of the
fortification clause of the Washington naval treaty. And that
expires December 31.
This is another revealing tip on ‘our. probable future
policy in the Pacific. We are already committed to playing a
lone hand, having not forgotten how England, Russia and
the rest deserted us when we counted on\co-operative pressure against Japan in Manchuria in 1931. :
Now it appears it’s to be a forceful hand\as well, at least
verbally. The kind of language that says: “You fortify, and
we ll' go you one better,” is the only kind, at present, that Japan understands. And until such time as Japan\shows herself ready to make treaties and ‘respect them, this will probably continue to be the United States policy. Apparently it is
the only way to“work for peace in the Pacific, and to discourage the erection of forts and bristling,armaments that tip the
scales toward war. :
President: Theodore Roosevelt, if you recall, once said:
“. believe that our future history will be more determined by
our position on the Pacific, facing China, than by our position on the Atlantic, facing Europe.” ~
That position can develop properly only if peace is
maintained. America’s future hangs in the balance. And so,
even more directly, does the future of California. .
