They went to Saicramento, to San

and finally to Octave where they obtained work in a mine. There Monte stated he became ill of ptomaine

Bernardino,
Colorado. winding up in Leadville,
where they were recognized and arrested.
Prior to Monte’s taking the witness stand, a long statement by each
of the brothers, taken in the sheriff’s office on their arrival from
Colorado, was placed in evidence by
District Attorney Vernon Stoll.
Throueh this statement, Attorney
Armstronms selected a number of
-qguotations asking the witness if he
had made them. The district attorney objected on the ground that all
the statements selected were all
“‘self-servine’’, that is serving to emphasize the testimony favorable to
the defemdants. It required so long
_ to read through the manuscript and

so that the trial might proceed with

The court adjourned until Monday, beeause today is law and motion day, and Saturday only affords
two hours for the frial, the afternoon being a holiday.
District Attorney Stoll made rapid
headway with his case yesterday
morning. :
Sheriff Carl Tobiassen, Coroner
L. R. Jefford, Deputy Sheriff Carl
Larsen, Jesse Younkers and . Ben
Coulor were on the witness stand
yesterday morning. d
Younkers, employed at a Grass
Valley hardware store, testified he
sold .12 buckshot shotgun shells to
Merritt and Monte Newman on
January 7th, five days before the
murder.:He said the shells. were similar to-ones found by Deputy Larsen
at the scene of the shooting.
E. H. Armstrong, defense attorney, asked the court fo make an or-.
der ‘prohibiting newspapers from
summing up the evidence in such a
manner that it might influence the
jury. Superior Judge Raglan Tuttle
said he would not take any action on
the request but instead admonished
the jurors not to be influenced by
newspaper articles.
Miss Coats, the principal witness
for the prosecution, was on the
stand a comparatively short time
Wednesday.

They got in their car and drove toward Nevada City.”
Miss Coats then testified she ran
along the highway towards Nevada
City until she saw another car parked along the highway. The man and
woman in this car drove her into
Nevada City and. she returned to the
scene of the shooting with Undersheriff William Woods. Myer was
brought to the Nevada City Sanitorium where he died several hours
later.
District. Attorney Stoll asked her

Rising from the witness chair,
Miss Coats pointed at the two defendants, seated near their attorney
E. H. Armstrong. and said: ;

Miss Coats’ voiice was steady.
Monte and Merritt Newman betrayed no emotion when they dir2:ty

On July 7th Miss Coats identified
the Newmans from among ten prisoners lined: up in the sheriff’s office

Stoll asked her if she had ever
