The action was filed shortly after the clerk’s office opening and within an hour Judge McDaniel had} rendered the judgment. Under the judgment the irrigation district verting any of the natural flow of . the South and Middle Foks or any . other tributaries of Yuba River at any time when the natural flow at. the eastern end of the gold com-. Pany’s lands and at the intake of the company’s irrigation ditches falls. below the amount sufficient to supply it with the continuous flow to which plaintiff is entitled, and also to supply such additional flow as may lawfully be diverted } . by other. lower Yuba River water users under appropriation prior to those of plaintiff and defendant.
