during the time the water in the mine increased but little. Yesterday the water came into the
mine so freely that the pumps could just hold it even.
The North Star had also to put speed on the pumps to keep the water down to a respectful
point. The Town Talk mine is running ahead with its water wheel. We asked superintendent
Walker if he found water enough to run that wheel, without assistance from the steam engine
which runs the battery in dry times. He remarked that water enough was falling from the roof
of the building to turn the water wheel.
RAIN.—Wednesday night there was rain, sleet and snow by turns. The fall for 24 hours up to 9
oclock yesterday morning was 2:30 inches. The storm is getting monotonous.
DISTRICT COURT.—In the case of Polkinghorn against B. F. Harris a verdict was rendered in
favor of the Plaintiff for $25. The suit had been brought for damages, for false imprisonment and
for damages generally. In order to carry costs the verdict should have been for $200 or more. The
plaintiff in the case refused to pay costs, and the result is the same as if the case had not been tried.
In other words the victory is with Marshal Harris.
In the case of G. D. Roberts, Executor vs. Brown, the default was set aside and defendant were
allowed to answer.
REVENUE CHANGE.—The Transcript of yesterday says:
Alfred Briggs, Collector for the Fourth Revenue District, has appointed I. J. Rolfe,
Deputy Internal Revenue Collector for the Fifth Division of the District, including Nevada
and Sierra counties. We are informed that Geo. W. Dixon, late Collector for this District,
resigned in consequence of having been elected Assistant Secretary of the Assembly, and
not being able to attend to the business. Mr. Rolfe is one of the pioneers of the county and
will make a good officer.
SATURDAY, JANUARY 13, 1872
RAIN.—The rainfall for 24 hours ending at 9 o'clock yesterday morning was 2:46 inches,
according to the Smithsonian Institute gauge kept by Dr. Kibbe.
LOCAL BREVITIES.—Those who are opposed to a no fence law, or a trespass law, are to meet at
Hamilton Hall this afternoon.
The Litigant Law did not save the Nevada National Gazette; the law ought to die for the murder
of that newspaper.
The Nevada City Benevolent Society is out of funds, and some suffering is the consequence.
The Society is a noble institution and it should be assisted.
SENTENCED.—Judge Reardon, presiding in the District Court, yesterday sentenced Benjamin
Reed to the State Prison for ten years. Reed had been convicted of man-slaughter, under an
indictment for murder. Reed had killed Christian Gunnison, some months ago at Nevada City. Judge
Reardon in passing sentence remarked that the jury which had tried Reed had been very lenient with
the prisoner. The testimony would have justified a verdict of murder in the first degree. Under the
circumstances Judge Reardon inflicted the full penalty of the law.
DISTRICT COURT.—Yesterday the case of Dodge vs. Turner was called up for trial, in the
District Court. A jury was empanneled and sworn to try the case. The action was one of trespass, and
damages were prayed for in the complaint in the sum of $100. The District Court considered that
it had no jurisdiction, as there was no question of title involved in the pleadings. The motion was
dismissed, on motion of defendant’s attorney, at the cost of the plaintiff.
