FATEFUL SUNDAY
EXCURSION
It had been Engineer Robert
Elliott’s first run, and a pleasant
one at that. His mission had
been to take a special excursion
train from Santa Cruz to the
Felton redwood grove for a
Sunday picnic.
The three cars on the train
were really only flat cars rigged
with seats. A light wooden
railing encircling the
ers offered the only
protection but that didn’t daunt
the exuberance and laughter of
the 150 passengers.At precisely 3:30 on May 23,
1880, Elliot pulled the whistle
and the train began its six-mile
y home. As the cars
rumbled through Tunnel 7,
squeals, hoots and yells rose
from the flatcars. Coming out of
the tunnel Elliot noticed the
train had picked up some speed
on the downgrade and was still
picking up more. He blasted the
whistle, ‘‘Brakes down.”
Nothing happened and the
locomotive and its trailing cars
began to rock and sway around
the curves.
“Can you slow down?” cried
Howard Antrim, the only man in
the cab familiar with the track.
“Tt drops 1266 feet to the mile
here.”
Elliot pulled his whistle again,
and although he could see the
brakeman setting the brake
wheels, the runaway picked up
speed. ;
Careening into a 14 degree
curve the locomotive tipped
precariously over the rushing
San Lorenzo river 500 feet

it. The second car was not so
lucky. :
Helpless and horrified, Elliot
watched it jump the track and
bounce jarringly along the ties,
tossing ers through the
railings on either side. The force
of the second car pulled the first
car off the tracks and more
passengers spilled over the side.
The last car stayed on the rails
and madly cut straight through
the path of destruction and
debris before it.
Elliot leaped from the
locomotive and scrambled back
to the scene. He found ten
mangled and mutilated bodies,
including one woman and a
small boy. More than forty
others were seriously hurt, five
of them fatally. It was one of
California’s worst train
disasters.

Public notice is heen given
that a Complaint and Petition
for Declaratory Order was filed
on July 1, 1975, pursuant to
Sections 1.6 and 1.7 (c) of the
Commission’s Rules of Practice
and Procedure, 18 C.F.R. S1.6
and $1.7 (c), by the Pyramid
Lake Paiute Tribe of Indians
(Petitioner) claiming that
certain hydroelectric facilities
owned by Sierra Pacific Power
Company (Sierra Pacific) on the
Truckee River in California and
Nevada are being operated
illegally. (Correspondence to:

Petitioner claims that Sierra
Pacific owns and operates the
Farad Plant .near Farad,
California, the Fleish and Verdi
Plants near Verdi, Nevada, and
the Washoe Plant near Mogul,
Nevada. It is further claimed

Petitioner alleges that Sierra
Pacific does not now have and
has never sessed a mit
from the ps of Engineers,
Congressional approval, or a
Federal Power Commission
license to operate the four
facilities.
Petitioner states that the
Truckee River, which rises in
California as the outlet stream
of Lake Tahoe, is the main
source of water for Pyramid
Lake. Petitioner claims that it
has relied upon the water of tt
Truckee River for maintenance
of the level and the quality of the
lake and for maintenance of the
Truckee River as the natural
spawning ground for lake fish
which Petitioner uses for food
and for barter. The Petitioner
alleges that the United States, in
establishing the Pyramid Lake
Reservation, impliedly
reserved sufficient water for the
needs of the Pyramid Lake
Indians.
Petitioner further oliegee that
the Floriston Rates for flowage
of the Truckee River were
designed to meet the
requirements of Sierra Pacific’s

alleged that this flow regimen is
in the best interest of
maintaining and preserving the
fishery in Pyramid Lake and in
the Truckee River. Petitioner is
currently in the U.S. District
Court for the District of Nevada
attempting to establish its rights
to the waters of the Truckee
River. Petitioner believes that
resolution of the Commission
jurisdiction question is_important to the District Court
case.
The relief requested in the
complaint is that a declaratory
order be issued stating that the
operation of the four
hydroelectric facilitives is
illegal, that Sierra Pacific be
required to cease operations of
the four hydroelectric facilities
in the absence of a Federal
Power Commission license and
that any further appropriate
relief be granted.
Any person: desiring to be
heard or to make protest with
reference to said complaint and
petition should on or before
September 22, 1975, file with the
Federal Power Commission,
Washington, D.C. 20426, a’
petition to intervene or a protest °
in accordance’ with _ the
requirements of the Commission’s Rules of Practice and
Procedure (18 C.F.R. $1.8 or
$1.10). All protests filed with the
Commission will be considered
by it in determining the appropriate action to be taken but
will not serve fO make the
protestants parties to a
proceeding. Any person wishing
to become a party in any
hearing therein must file a
petition to intervene in accordance with the Commission’s Rules. The application
is on file with the Commission
and available for public inspection.
