. eeting called to order at the hour of 10:00 A,M, and all

Chairman authorized to sign the Claims Register, thereby
releasing the following ee. payment:

The Director of the Dept, of Public Works appeared before
the Board, and presented the report of his Department,
Mr, Meade reported that an Agreement had been worked
t through Beale AFB, that whenever government planes are
involved fighting of fires, they could land at Beale and fuel
at Beale,
The decision of the Planning Commission on the Orchard
Springs Road Mobile Home Park was upheld, and the appeal
was denied, However, an order was directed to the Director
of the Dept. of Public Works, to keep abreast with the growth
of the Park, and to do everything possible to maintain the best
possible traffic safety. A letter was written to the Developer,
urging him to do everything under his power, to insure obtaining a "Five Star Rating."
The Auditor-Controller presented the report of his Department,
The Board adopted Resolution 67-305 (A Resolution setting a Public Hearing on the Dissolution of the Nev. Co. Waterworks District No. I, for January 9, 1968.)
A Special Meeting of the Waterworks District No. I was
set for January 9, 1968,
e following Resolutions were adopted by the Board:
Resolution 67-306 (A Resolution initiating the procedure
for the formation of the Loma Rica Airport District.)
Resolution 67-307 (A Resolution determining and declaring
that the Public Interest, convenience and necessity of the
Co. require the acquistion of certain land on the Perimeter
Road and directing the filing of Eminent Domain ProceedingsVotendahl Property.)
A Resolution accepting a Petition to form a Permanent
Road Division known as Panorama Tract, ordering publication
of the Petition and setting Public Hearing.
Resolution 67-309 (A Resolution authorizing Agreement between the Co. of Nev. and Greenwood and Associates, pertaining to topographic maps for a portion of McCourtney Road
and Rattlesnake Road.)
Resolution 67-310 (A Resolution accepting Deed from the
Bursill's.)
The Planning Director appeared, and presented the foliow Petitions for Exception, which were approved by the

Resolution 67-311 (A Resolution approving Exceptions to the
Nev. Co, Subdivision Ordinance, for the Tentative Map of
Sierra Meadows Unit No, 3.)
Resolution 67-312 (A Resolution approving Exceptions to
the Nev. Co, Subdivision Ordinance, for the Tentative Map of
Alta Sierra Estates 14,)
The Purchasing Agent appeared and presented bids for
the demolition of two burned buildings in Truckee,
The bids were opened, but were not awarded at this time.
The Board adopted Resolution 67-313 (A Resolution authorizing the Dept. of General Services of the State of Calif,,
to purchase one only, Calif. Highway Patrol Vehicle for the
Co. of Nev.)
The Board adjourned for lunch,
AFTERNOON SESSION:
The Board reconvened at 1:15 P.M., with all Supervisors
noted as present with the exception of Supervisor Loehr.
A Public Hearing was held on Prosser Lakeview Estates
Unit No, 2 Assessment District, and the following Resolutions
were adopted:
Resolution 67-314 (A Resolution directing filing ofan amended Engineer's Report and amended Estimate of Cost.)
Resolution 67-315 (A Resolution authori execution of
Agreement with the Public Utility District.)

LEGAL NOTICE . Nevada City Had Its Hoodiums at the
‘Turn of the Century —
_ EDITOR'S NOTE: While today's newscasts and newspaper
items carry stories of hippie
pads, marijuana raids and
drunks and other unpleasantness ©
it evidentally was no different
‘at the turn of the century asthis
story of an incident in Nevada
City in 1898 is retold.
The Daily Morning Union reported the incident with this
headline:
‘* ASSAULT ONOFFICER KILROY, Three Burly Brutes Badly
Use Him Up. They Also Raise
Cain, Scarcely Stopping at Anything— Strong Sentiment Against
Them,”’’
The report continued:
One of the most brutal and
cowardly assaults ever attempted by young men in this city was
the one at about 1 o’clock in the
morning. At the time the item
was written, the particulars of
the outrageous affair were not
fully known, but yesterday a reporter investigated the case and
no other conclusion can be arrived at but that Charles Dennis, ‘‘Pet’’ Beardsley and James
McCluskey, the parties implicated, deliberately and wilfully
beat and kicked nightwatchman
William Kilroy because he was
discharging his duties as an
officer of the law. All three
of the young men are strong,
athletic fellows and the fact
that all three jumped upon the
faithful is evidence enough that
the assault was cowardly in the
extreme, He had not the ghost of
a chance with them and in his
helpless condition he was treated only as a brute would treat
a dog. .
The Officer Was‘a pitiful sight”
yesterday and has not recovered
from his injuries and last night
he was unable to attend to his
duties. and constable Scott took
his place, Mr, Kilroy’s version
of the disgraceful affair is as
follows:
“T had seen Beardsley, Dennis
and McCloskey around town before the trouble and they were
evidently under the influence
of liquor. Between 12 and 1
o’clock I walked over to the
corner of Pine and Spring Streets
with City Trustee Rich and while
coming back I heard loudhollering. The three were standing on
Lammon’s corner. Later on they
moved down Pine Street in front
of Turner’s store and commenced to make a racket with the
mining car standing on the sidewalk. I shouted to them to desist, when one of them called
out; "You are a d----liar."They
kept up the noise and I walked
a little farther down the walk
and again asked them to stop.
_ and one of them repeated what he
had said before and they kept.
rattling the car. I then went down’
to where they were and said:
“‘Boys, why do you want to act
like this; you are making too
much noise; I treat you all
pretty well and am not mean and
don't want to be after you all
the time.
“At this juncture McCloskey
stepped forward and squared
off at me, saying, ‘‘who are
you?’’ I told him who I was
and then when I saw trouble
ahead, I struck McCloskey with
my club, One of them then said
that I could not use the club on
any of them and the next thing
I knew I received aterrible blow
under the chin and fell over on
the sidewalk, I must have been
knocked unconscious because
the next thing I knew I was lying
across the street near Conroy’s
saloon with my coat over my
head and the crowd was kicking,
I said ‘‘my God boys, don’t
kill me, you have got the best
of it.’’ One of them then said,
*“‘We have got you where we
want you, when another one said
‘don’t kick him anymore,’’ I
then caught hold of a post and
managed to draw myself up to
my feet and started down the
street and fell again on the sidewalk from weakness,’’
The nightwatchman was met
by W. H. Tuttle and J, S, Gregory and they led him to theUnion hotel where he was washWhen seen last night none of
the accused would give a statement of the affair and from
what the officers say it will be
seen that it is a wonder that
Kilroy was not killed.
When the particulars of the.
incident became known around
town yesterday morning, public sentiment was aroused in
such a pitch that all kinds of
strong talk was directed against
the brutes and universal sympathy is with the officer,
After brutally beating the officer the trio left for Grass Val.
ley, When near Glenbrook Park
they met R. J, Gates, who was
on his way to Grass Valley
and they stopped him, Two of
the trio jumped on the horse’s
back -and one n the seat,
After bothering him for nearly
fifteen minutes they let him go
~ and. when near Grass Valley
they mét Earnest Tibbitts, a
* Newspaper carrier and did not
let him pass until they forced
the lad to take a drink of whiskey
out of a bottle which one ofthem
carried,
They returned to this city on
the morning train and were ar.
rested on the charge of battery
by Sheriff Getchell and Marshall
Tompkins and Justice Holbrook
held them under $500 bonds,
each, in default of which they.
were lodged in the county jail. :
During the day they secured A.D.
Mason to defend them and when
brought before Justice Holbrook
last evening they plead not guilty
to the charge. ~
William Kilroy has made the
best nightwatchman Nevada City
has ever had and because he
has faithfully discharged his duties he has naturally gained the
enmity and hatred of all the
hoodlums and criminal element,
but the good citizens are praising him for his honesty of purpose and will stand by him in
securing justice,
After the combat with the officer the brutes saw him in the
hotel and one of them remarked,
“that was a dandy kick I gave
him in the jaw,’’ and other just
as fiendish remarks were made.
While going to Grass Valley
they stopped at Sutton’s place
and frightened the ladies in the
household,
.On Piety Hill nearly every
electric: lamp: globe: was. broken
and it is believed the same trio
did the work.
The City Trustees held a special meeting last night and instructed Trustees Rich and Rector to engage City Attorney Ford
to assist the District Attorney
in prosecuting the officer’s assajlants, but should he not return from San Francisco intime
they will engage other counsel,
Justice has been dealt out altogether too loosley in this city
of late and in the present case
the defendants should be prosecuted to the full extent of the
law and the maximum penalty be
meted out to them,

obtain bonds and were released
from custody
