OF NEVADA CITY PRESCRIBING
REGULATIONS FOR T HE GRANTING OF FRANCHISES FOR THE
CONSTRUCTION AND OPERATION OF COMMUNITY ANTENNA TELEVISION SYSTEMS
THE CITY COUNCIL OF THE
CITY OF NEVADA CITY DOES
ORDAIN AS FOLLOWS:
Section 1. No person, without
having first acquired from the
City Council a franchise so to
do, shall construct or operate a
community antenna television
system within the City of Nevada
City.

written application therefor, the
City Council, by resolution, may
grant a franchise to any person for
the construction and operation of
a community antenna television
system within the City of Nevada
City, upon the terms and conditions prescribed in said resolution
and for a period not to exceed
twenty-five (25) years. The resolution granting such franchise
may include terms and conditions
other than those set forth in this
ordinance, solong asthey are not
in conflict with the provisions of
this ordinance. The Council may
limit the number of franchises to
such number as in its judgment
will best serve the public health,
safety and welfare.
Section 3. Any cable television
franchise granted pursuant to this
ordinance may authorize the
grantee thereof to place wires,
conduits and appurtenances for
the community antenna television system along or across public
streets, highways, alleys, public
properties or public easements of
the City. Public easements, as
referred to herein, shall include
but shall not be limited to any
easement created by dedication
. tothe City for public utility purposes or any other purpose whatsoever.
Section 4. Before granting a
franchise under this ordinance,
the City Council shall hold a public hearing upon the application
so made, at which hearing all
interested persons may appear and
be heard. The Council shall, by
resolution, fix the time and place
of such hearing, and shall cause
a notice thereof to be published
once a week for two successive
weeks. The date of said hearing
shall be not less than ten (10) days
nor more than thirty (30) days
after the date of the first publication of such notice. The hearing
may be continued from time to
time as the Council may deem
necessary.
Section 5. The grant of any
franchise hereunder may be made
upon the basis of the quality of
service,. rates to the subscriber,
income to the City, experience
and financial responsibility of the
applicant, and upon any other
consideration that will safeguard
the local public interest.
Section 6. The grantee of a
franchise hereunder shall pay to
the City, during the term of such
franchise, a fee equal to 2% of
the gross annual receipts, if any,
arising from the sale of antenna
service to subscribers within the
City. Only regular periodic service charges, not including any
State or Federal taxes levies upon
~such service, shall be considered
in computing gross receipts. Or_iginal installation charges, reconnection charges, and charges
made for inspection, repair, replacement,. or modification of
installations, shall not be considered in computing gross receipts.
If in any calendar year the amount
of the fee, so computed, is less
than $100.00, the grantee shall
pay tothe City a minimum fee of
$100.00 in lieu of-said percentage fee.
Section 7. The grantee shall
file with the City Clerk, within
thirty (30) days after the end of
each calendar year during which
a franchise is in force, a verified
statement showing in appropriate
detail the total gross receipts of
the grantee during such calendar
year for the sale of antenna service to subscribers within the
City. The grantee shall pay to
the City, within fifteen (15) days
after the time for filing such
statement, the required fee for
the calendar year covered by the
statement. The grantee shall
keep full and true records of all
gross receipts from the sale of
antenna service, andsuch records
shall be open to inspection or
audit at all reasonable times by
the authorized agents of the City.
Section 8. No franchise granted
hereunder shall impair or affect
the right of the City to acquire
the property of the grantee by
right of condemnation or eminent
domain, and nothing contained
herein or in any such franchise
shall be construed so as to. abridge
such right.
Section 9. Every grantee under
this ordinance shall file a bond
running to the City, in such sum
as the City Council shall deem
adequate, conditioned that the
grantee shall well and truly observe, fulfill and perform each
and every term and condition of
such franchise. The bond may be
executed by at least two good and
sufficient individual sureties to
be approved by the City Attorney,
or by acorporate surety, and shall
be filed with the City Clerk within thirty (30) days after the passage of the resolution granting the
franchise.
Section 10. Any franchise
granted under this ordinance shall
not become effective until a
written acceptance thereof by the
grantee, together with the bond
required by Section 9, shall have
been filed with the City Clerk.
If the acceptance and bond are
not filed within thirty (30) days
after the granting of the franchise, the franchise shall be
deemed forfeited.
Section 11. Every grantee under
this ordinance shall:
(a) Construct, install and maintain all wires, conduits and appurtenances in conformity with
all regulations heretofore or hereafter adopted by the City Council
in the exercise of its police
powers, and in conformity with
all applicable laws of the State
of California.
(b) Pay to the City, on demand, the cost of all repairs to
public property made necessary
by any operations of the grantee.
(c) Indemnify the City, its officers andemployees, against all
claims, demands, causes of action, damages, costs or liabilities
proximately resulting from the installation, maintenance or use of
equipment by the grantee in the
public rights of way, or from any
interruption, discontinuance or
interference with the grantee's
service to any of its subscribers
caused or claimed to have been
caused by any action of the City
pursuant to or consistent with any
franchise granted under this ordinance; and the grantee shall,
upon demand, at his sole risk and
expense, defend allsuits, actions
or other legal proceedings brought
by third persons against the City,
its officers or employees, on such
claims, demands or causes of action, and shall pay and satisfy any
judgment or decree rendered
against the City or any of its officers or employees in any such
suit, action or legal proceeding.
The grantee shall keep in full
force a policy of public liability
and property damage insurance,
in such amounts as the City Council shall deem adequate, and
shall file with the City Clerk a
certificate of such insurance stat~ing that such policy shall not be
cancelled or changed during the
period of coverage unless written
notice thereof be given to the
City at least ten (10) days in advance of such cancellation or
change.
(d) Upon the request of the
City, remove or relocate such of
the grantee's facilities as may be
required by street vacation, or by
the improvement, re-alignment
or other change in public streets,
highways or other public property.
(e) Upon the termination or forfeiture of the franchise, remove
any and all facilities installed,
used or maintained by virtue of
said franchise.
(f) Within thirty (30) days after
any sale, transfer, assignment OF
lease of any franchise grante d
under this ordinance, OF of any of
the rights or privileges granted
hereunder, file with the City
Clerk written evidence of such
transaction.
(g) File with the Building Inspector and the Superintendent of
Streets detailed plans of all proposed construction, and secure
the written approval of the plans
by.such officers before construc ~
tion begins.
(h) Make av ailable all such
facilities for civil defense when
required by the Director of the
Nevada County Disaster Office.
12. Construction of the community antenna television system
for which a franchise has been
granted under this ordinance shall
be commenced in good faith
within 180 days after the passage
of the resolution granting the
franchise, or within such further
time as the City Council may
allow upon a showing, by the
grantee, of unavoidable or excusable delay in obtaining the
necessary agreements with utility
companies for the joint use of
poles and related fac ilities.
Thereafter such construction shall
be prosecuted with reasonable
diligence so as to fulfill the reasonable needs of the inhabitants
of the City.
13. Upon the failure of the
anteeto maintain the bond required by Section 9 or the insurance required by Section 11(c),
the City Council may immediately declare a forfeiture of the franchise. In the event that the
grantee shall be in default of any
other condition or requirement of
the franchise and shall failto cure
or correct such default within ten
(10) days after the service of
written notice thereof, the Council may declare the franchise forfeited; provided, however, that
before such forfeiture is declared,
the grantee shall be served with
written notice of the Council's
intention to declare a forfeiture,
specifying the ground or grounds therefor, and fixing a time and.
place when and wherethe grantee
may appear before the Council
and show cause, if any he may
have, why the franchise should
not be forfeited, such hearing to
be held not less than ten (10) days
after the service of such notice.
Allnotices under this Section 13
shall be served by certified or
registered mail, addressed to the
grantee at his or its address on
file with. the Council, and shall
be deemed served on the date
next succeeding the date of mailing.
14, The City Clerk shall cause
this ordinance to be published
once, within fifteen (15) days
after its final passage, in the
Nevada County Nugget, a news~
paper of general circulation published and circulated in the City
of Nevada City.
Passed and adopted at a regular meeting of the City Council
of the City of Nevada City, California, this 10th day of February,
1964, by the following votes:
