Mr. Beatty, County Clerk, testified to receiving the package, andehat it had pot been tampered with, and-hadbeen. under lock atid key since it came into his possession. He wrote tickets and sent them down there and elsewhere as he testifies. I havedone “. ath things myself. It isa very common:thing for candidates to do this thing. In the absence of proof that s. the ballots have been tampered with there can be but one result. For some reason, according to the evidence, the result of the election was not correctly tallied and returned. If my judgment on this point or any other is not correct it is subject to. review by higher Court. It might be suggested as extraordinary that so many ballots were scratched in favor of Mp, Lord, I went through them all carefully to ascertain ifthere were other such apparent discrepancies. I found that on both sides the Sheriffs’ names were scratched 120 times ‘and the Recorders’ 144 times. There were hardly any straight ballots on either side. His honor concluded his remarks, the substance only of which is given above, by giving judgment in favor of the contestantin accordancé with the tally ofthe recount. He requested counsel for the contestant to prepare findings and judgmentin accordance with such decision. Five days’ stay of proceedings was granted.
