Do We Have Planning? (Continued from Pade 1)
a, show the effects of sloppy, unplanned growth, New
England today retains much of the charming character
with which it was originally blessed. Population growth
_ hasincreased demands upon all branches of government
to provide adequate public services, such as more schools
_ for morechildren, roadsto carry more traffic, improved
water systems to supply more water for domestic and
industrial purposes and for fire protection, new sewage
“Systems. to carry off the waste generated by more congested human occupancy of the land, and increased demand for all the other governmental services and facilities which are generally accepted as a part of our civil“ization,
Increased demand for public services and facilities resulted in increased demands upon taxpayers to finance
the growing cost of providing these services, It became
apparent that some agency should look ahead to plan for
the future physical development of cities and counties
to avoid wasting large sums of public money on projects
that might shortly become inadequate or obsolete, In
many respects government is a big business, and after
all, what large corporation could stay in business if it
did not plan its operationsin advance? Aeroject General
Corporation, for example, plans ten years in advance,
and any timber company must plan at least forty years
in advance to harvest trees it plants today.
The job of planning cities and counties is generally
delegated to local Planning Commissions, working in
close cooperation with property owners and practically
every agency of local, state and federal government.
Inthis way, Planning offers an unparallelled opportunity
for determining community goals through the democratic
process to guide public officials in making policy decisions, If there is no plan, and the governing body is
forced totake emergency action when a crisis develops,
the opportunity for democratic action is lost, and such
hasty decisions are not always in the best public interest.
The Nevada County Planning Commission has jurisdiction only in the unincorporated portion of the county.
It consists ofnine voting members who are appointed for
four-year terms by the Board of Supervisors. By county
ordinance, three voting members must be county officials. These planning commissioners do not receive
any pay for their work, except the satisfaction of helping to promote a better civic environment.
In previous years the planning commission has employed various part-time consultants to take care of day
to day operations of the commission. In June, 1961 the
office of Director of Planning was established on a fulltime basis, The Planning Director is a regular salaried
county employee appointed by the Commission, and
subject tothe rules which govern other county employees.
The Planning Director doesnot have a vote on the Commission, but serves to provide professional advice to the
Commission on technical Planning matters.
DUTIES OF THE PLANNING COMMISSION
The Planning Commission is primarily an advisory agency to the Board of Supervisors, although it may be
granted specific administrative powers by county ordinance enacted by the Board of Supervisors, the elected
representatives of the people. As an advisory agency,
the planning commission is required to recommend action tothe Board of Supervisors on physical development
programs and other matters that the Board may refer for
investigation andreport. The planning commission should
make an impartialrecommendation asto what is best for
the county, irrespective of political considerations,
Specifically, city and county planning commissions are
authorized and required by Title 7 of the Government
Code of the State of California to:
Prepare and adopt a long-range comprehensive general plan for the future development of the area within
their jurisdictions, and forward it for official adoption by
the governing body. Once the general plan is offically
adopted, the commission is required to recommend to
the governing body and other agencies, ways and means
of accomplishing the plan.
A general plan may be defined as a map and supporting data showing the future development of the county.

It consists of three main elements; Land use, Circulation,
and Public Facilities, It should be based on what the
people want the county to become, and when adopted,
it serves as a policy guide to the Planning Commission,
The Board of Supervisors, other agencies and individuals.
Nogeneral plan has been prepared for Nevada County,
but the Planning Commission has begun to plan for the
_ general plan program,
The Planning Commission is also required to administer the Nevada County Zoning Ordinance, This Ordinance, which was adopted in 1953, is a good example of
the inequities which occur when a community begins
with a minimum ordinance with the idea of improving
the ordinance when the need develops. For example,
Planning Director Bill Roberts
a motel requires a use permit but no use permit is required for a concrete plant. The ordinance is so ineffectual that many people do not realize that we have
a zoning ordinance, and it provides little protection to
the public. To be effective, logical zoning for the
proper use of land should be based upon a general plan.
Thethird main duty of the planning commission is to
act as advisory agency totheBoard of Supervisors on subdivisions, At the present time Nevada County is operating under the provisions of the Subdivision Map Act,
which isthe state law regulating the platting of subdivisions, The Subdivision Map Act should not be confused
with the California RealEstate Commissioner's Law,
whichis for the sole purpose of preventing misrepresentation and fraudinreal estate transactions and is adminby the State Real Estate Commissioner,
The Subdivision Map Act is general in nature, Its
main purpose is to give counties and cities the power to
regulate subdivisions, As you know, local governments
derive their powers from the states, which in turn are
granted power by the federal government and the Constitution,
The Subdivision Map Act requires that tentative and
final maps of subdivisions by approved be the Planning
Commission and the Board of Supervisors before the maps
can berecorded, The Map Act also requires that a local
ordinance be enacted for regulating the design, improvement and survey data of subdivisions, the form and
content of tentative and final maps, and the procedure
to be followed in securing official approval of subdivisions, As most of you know, Nevada County does not
have a subdivision ordinance,
Without a subdivision ordinance, it is difficult for a
landowner or potential developer to make an intelligent
investment in a subdivision because he does not know for
sure what will be required by the county as a condition
of approval. Inotherwords, the subdivider is left guessing what will be required before he can sell a lot up until the final map is actually approved by the Board of
Supervisors. Until subdivision regulations are adopted as
official policy, the Planning Commission and the Supervisors do not have aconsistent basis for judging whether
a given subdivision map should or should not be approved.
Subdivision ordinance standards should be based upon
what kind of county the people want this one to become.
In other words, what kind of design and improvement
standards should be met.
There are many productive uses of land such as grazing, timber growing, mining, which now provide the
basis for our local employment, and without land for
these purposes we must find some other economic base
such asrecreation, Let us assume that land is being subdivided for homesites, These may be large sites or small
sites, depending upon the market demand, but in either
case there are some things that must be provided before
any person of reasonable intelligence will build a home
on the land: @
1, A marketabletitle -A guarantee that he is building on land which he owns or to which he can acquire
a clear title,
2. Automobile access to the property -not everyone
ownsahelicopter, Automobiles require roads built to
certain standards within the physical limitations of the
carand driver, Such roads might be public or private
tights-of way or easements of adequate width and in
locations where a road can in fact be built,
3, A safe water supply is essential for human lifeeither wells or public water supply. If you want fire
protection, there should also be fireplugs with adequate
water supply for firefighting.
4, There should also be some means of providing adequate sewage disposal; either the lot should be big
enough for septic tanks and drainfields, or there should
be connection to a sewage system,
These are basic requirements which everyone would
need before building a home, whether or not there is a
subdivision ordinance, The purpose of the ordinance,
then, isto set out the minimum standards for these factors in Nevada County.
These improvements cost money. Who should pay?
1, The Subdivider who makes the profit from the sale? .
2, TheBuyer -whoisalready in debt for the purchase?
3, The general taxpayers of the county?
Is the motto of Nevada County "Let the buyer beware"?
If it is, then let’s put up signs in the county so people
will know what they are getting into,

The American Field Service sponsors students sent

There will be an assembly Feb, 13 atl p.m. Foreign exchange students from

discipline? What do you
think about cheating?” The
Student Ethics Committee
will read the answers given

them in drawing up a Code
of Ethics for NU.

College A Cappella Choir,
under the direction of Dr,
John Carl Tegnell. They
sang excerpts from Berlioz’
"L'Enfance du Christ" (the
infancy of Christ), three American Negro Spirituals,
and three Spanish Madrigals
which were performed by the
Chamber Choir, directed by
Don Grimes, assistant directorofthechoir, That evening, the choir presented a
programin the gym, during
which they performed the
songs mentioned before and
a number of others. A member of this choir, Carlton
Burille, graduated from Nevada Union last year.
