The hay-wagons, each drawn by six oxen are coming in from Penn Valley with fodder for the horses and mules of the express companies that operated from Nevada City and Grass Valley in those days so long ago. In the first picture we see where the teamster let his oxen rest, perhaps while he went into the Holbrooke Hotel bar for a glass of draft the hotel is still there. One of the oxen really took advantage of the break, he just stretched out right there in the street. Why not? . There was no Peterbuilt truck and trailer stacked twenty feet high with lumber, coming roaring up Main.” Why not enjoy every second of rest why not? In the second picture the wagons are rolling again; on the far side of Main street we see they sold Bohemian Beer, om \ r on draft, next door to Jim Gluyas’ store that was before Jim became James and’a Mine Superintendent. They have been joined by a myriad of anglers, whose interest in the fish may sometimes be more personal, but who reinforce the claims to rights to water on the part of the fish, Water project planners in California rather generally have. been aware of their finny friends. As a result of this awareness, many more fishing opportunities are available in the State than was the case originally, Therights of the fiSh have been variously stated. Some ofthem have been incorporatedintolaw.° The Fish and Game Department on the part of the State and the Fish and Wildlife Service of the Federal Government have divisions that work with water project planners. A good recent statement of fish rights is found in the California Public Outdoor Recreation Plan, Part II. It is: "No wildlife resource nor itshabitat should be permanently destroyedin development or control of other natural resources, including water. "The aesthetic values of fish and wildlife should be recognized and measured in terms other than those of . economic value. New concepts and evaluations, based on study, are needed. "The damage to fish and wildlife resources as a result of the various uses of water should be compensated for or mitigated. Cost of such damage, or prevention thereof, should be borne by those benefiting directly .
from such uses of water. "Fish and wildlife belong to all the people; thus. the protection, propagation, and enhancement of their environment is a responsibility of all the people, “Asa part of the American heritage and right, maximum opportunity should be provided to. every person to use and enjoy fish and wildlife resources in any reasonable manner be desired. " Inregard to fish, the recreation plan makes two recommendations of interest to the water project planners. Souza Brothers of Yuba City was lowest of three bidders. One section lies 0.3-mile either side of Ramshorm Cteek, which is about six miles west of Downieville. The other 2.8 miles runs easterly fromthe Yuba River bridge to a mile east of the Indian: Valley campground. The bridge is located approximately 13 miles west of Downieville. Both sections have been realigned and widened over the past several years.
