Bench of Nevada County
The Nugget, like individuals in the county, is infected with "election fever." It's
editor has delved into 100 Years of Nevada County to present a word picture of
duties of some of these offices in 1951,
Nevada County with only six superior
court judges since the office was formed
in 1881, is among the counties of the
state boasting of a minimum turnover
_ of the judicial office holder.
Nevada County cannot only boast of
a minimum number of judges, but can boast
of a high quality in themen who have
filled the post.
John Caldwell took over the superior
bench in 1881 after serving 10 years as
county judge. He was succeeded in 1885
by J. N. Walling who presided at the notorious George Lord ballot recount trials,
an account of which appears elsewhere in
this edition.
Caldwell resumed the post in 1891
and was succeeded by Frank T. Nilon
in 1897,
George L. Jones served 18 years inafirst. tour. of duty from 1909 to 1927,
and eleven years later resumed the bench
for nine years from 1938 to 1947. Raglan
Tuttle presided between the two tours of
James Snell, the current judge, has
been on the bench since 1947.
Prior to 1881, county judges and the
year of taking office were Henry P. Haun,
1850; T. H, Caswell, 1851; David Belden,
1859; A. C. Niles, 1863; Caldwell, 1871.
District judges were: W. B, Turner,
1850; Gordon N. Mott, 1850; William T.
Barbour, 1851; Niles Searles, 1855; T.
B, McFarland, 1861; T. B. Reardon, 1869.
The Nevada County superior court
handles criminal, civil and juvenile cases.
Juvenile court is unique from the others
in that hearings are not open to the public, cases being heard in the judge's chambers. In addition to handling cases of
delinquency, juvenile court is subject to
petitions requesting minors be made wards
of the court, as in the case of orphans.
The average criminal case which goes
to superior court starts with an arrest.
This is followed by a preliminary hearing in an inferior court at which the defendent must be present. A grand jury
can accomplish the same thing in the
absence of the defendant.
Hf at the preliminary hearing the defendant is unable to show cause why charges should not be pressed further, he must
appear in Superior court for arraignment.
Here he may plead guilty or not guilty.
If he pleads not guilty, a trial date is
set. Those who plead guilty appear before
a superior court judge for sentencing.
Civil cases are initiated by a series
of complaints and answers filed with the
county clerk by contesting parties. When
an issue has been reached a trial date
is set and the case is put on the calendar of one of the civil departments. Matters handled in civil courts include damage suits, condemnation suits, divorce
suits, and probates,
