Lake Properties, a County Officer was personally interested in the project. _ “Preliminary investigation by the Disttieh Attorney 's Office shows that there is some basis for that conmpfaint. “The matter witl be in the hands of the Grand Jury of Nevada County, and I expect they will examine it closely and take proper action as soon as their investigation is ete: . "In the meantime, because of the clouded situation, . have two requests to make: ; "The Aree is to you as a Board of Supervisers, I eamestly ask you to n afeasibiliry report from an independent engineering firm, By:independent I. mean one which is notselected by Western Lake Properties, and one which willbe completely free to tell you what the findings are, With such a report you will know the practicality obime Pleats: you created andbe ableto eximate fs Waterwork Di: : Number 1:. I suggest you order that‘all action be withheld*in going ahead with your contract of May 9, 1967, so far as islegally possible, until the feasibility report is obtained, and that-you take: whatever steps are necessary to properly postpone such action until you know all the circumstances under which. this District was formed and this contract approved, "I ask that you.give this your immediate:and most careful at~< tention, and assure. you that I will do everything I can in the County 's interest to help find the facts you wili need," Board Takes No Action The board took no action onthe District Attorney’s recommendations, The matter was discussed and it was decided to wait for the Grand Jury's report, -“i , ‘The law is specific as to the charges in the District Attorney's statement. If the charges are proven to be true, thé contract * between the County, Western Lake Properties and the N.I.D. could become void. The State law concerning the District Attorney's charge reads as follows; ; ",.A public office is a public trust created in the interest and for the benefit of the people, (4) Public officers are obligated to discharge their responsibilities with: integrity and fidelity, (5) Since the officers of a governmental body are trustees of the public, they may not exploit their official position for their private benefits. When public officials are influenced in the performance of their public duties by considerations of personal advantage, they violate their oath of office and the public is injured by being deprived of their loyal and honest services, (6) It is therefore the general policy of this state that public officers shall not have a personal interest in any contract made in cs ir official capacity.(7) A transaction in whi e interest of a public officer appears is held yoid both as to the public policy expressed in the statutes and because the interest of the officer interferes with the unfe ttered discharge of his duty to the public, " Onorato Replies To Charge Robert C; Onorato, president of Western Lake Properties, conferred with County Attorney Leo Todd for a few moments in the county supervisors’ chambers and later made this statement to the NUGGET: "I am shocked and disturbed by the accusations made by the District Attorney, We stand ready to have the Grand Jury investigate every aspect of our organization, If the accusations are proven unfounded and Western Lakes incur any damages from these accusations, and I'm sure we will, you. can be assured that Western Lakes will seek to recover damages from the governmental agency responsible, " When asked if he knew who the county officer alluded to in the attorney's statement was, Mr. Onorato replied, "I have no idea.“ PEKRIOOICALS SECTIO “CAL ST LIBRARY © On Way — Hippies continue to filter throngh NevedaCity, on their way to the Hippie sinus. camp near the Malakoff dig“ gings, Not many of the Hippies stay long, but there is-defi-. nitely interest in our mountains among their members.
