Verdict
Reversed
The third district court of
appeals in Sacramento last
week reversed aNevada
County jury conviction of
CharlesC.R. Kennedy. Kennedy was convicted of grand
theft last year on the charge
of obtaining a $3,600 promissory note from Mr. and Mrs .
William Chambers, former
operators of the Gold Nugget
Inn.
The reversal was based:on
the contention that Judge Ben
Ragain shouldhave admitted
evidence that he refused to
admit, and that prosecuting
attorney Harold Berliner asked questions of one of Kennedy 's chafacter witnesses
which did not relate to the
traits for which Kennedy was
being tried.
A rehearing in the same
court will be requested by the
state attorney general, according to Berliner.
