* You are hereby required to appearin an
action brought against you in the Superior
Court of the County of Nevada, State of California, on twenty-ninth day of Geer
1887, by JOHN CU RRY and MARY A. CURRY, Plaintiffs,and to answer the complaint:
filed therein, within ten days (exclusive of
thé Atay of service) after the service on you
ofthis Summons, if served within this County; or, if served out of this county, within
thirty days, or judgment will -be taken
against you by default according to the
prayerofsaid complaint
The said action is brought to ‘obtain a decree of this Court.for the foreclosure of a
certain_mortgage described inthe said complaint and executed by the said H.'G. Batty, on the 28th day of April, 1886, to secure
the paymentof a certain promissory note
dated April 28th, 1886, due. cighteen
months or before, after date, for the sum of
Four Thougand Sevén Hundred Dollars,
with tnterest thereon at six per cent, per
annum until paid, that the premises conveyed by said mortgage may be sold, and
the proceeds applied to the
amount due uporsald promissory note, as
follows, to-wit : The principal sum of $4,700
with interest thereon from April 28th, 1886.
at the rate ofsix percent. per annum, and
five percent upon th amount. found due
for Attorney's fee, and costs of Bult. And
in case such proc eeds are not sufficient to
pay the same, then to obtain .an Execttion
against said Fi. G. Batty forthe balance remaining due, and that also the said defendants and all persons claiming by, through or
under them or either of them may be barred
and foreclosed of all right, title, claim, lien,
equity of redemption, and interest in and
to said mortgaged premises, and for other
and further relief.
And you are hereby notified that if you
fail to appear and answer the caid complaint
as above required, the said plair tiffs will
apply to the Court forthe relief demanded
in the said complaint.
