The City Council. of the City of Nevada City does ordain as follows: Section 1, PURPOSE OF ORDINANCE, This Ordinance is enacted for the purpose of adopting rules and regulations permitted by the State Housing Law of the State of California, for the protection of the public health, safety and general welfare of the occupant and the public governing the erection, construction, enlargement, conversion, alteration, repair, movin a removal, demolition, occupancy, use, height, court, area, Sanitation, ventilation and maintenance of all buildings and structures in the City of Nevada City; provided, however, that nothing contained in this Ordinance, or in the codes hereby adopted, shall be construed to prevent any person from performing his own building, plumbing or electrical work when performed with the permits and in compliance with this Ordinance, Section 2, ADOPTION OF UNIFORM BUILDING CODE, The Uniform Building Code, 1961 Edition, together with the appendix thereto, as adopted by the International Conference of Building Officials, three copies of which code, certified by the City Clerk to be true copies thereof, are on file in the office of said City Clerk, is hereby adopted by reference as the Building Code of the City of Nevada City, with the ’ following amendments: (a) The second paragraph of Section 205 is deleted, (b) Section 1309 (Appendix) is deleted, (c) Section 1601 (a) is amended to readas follows: Section 1601. (a) Fire Zones Defined. For’the purpose of this Code, the entire City of Nevada City is hereby declared to be, and is hereby establishedas, a Fire District, and said Fire District shall be known and designated as Fire Zones No. 1, No. 2and No. 38, as hereinafter defined. Whenever in this Code any reference is ma de to any fire-zone, it’ shall be construed to mean one of the fire zones hereby created, (1) Fire Zone No. 1 shall include the territory bounded as follows: Beginning at the intersection of Coyote, Marin and Union Streets, thence from said point of beginning along the center lines of the following streets, as follows: along Coyote Street to Washington Street; thence along Washington Street to York Street; thence along Y ork Street to Commercial Street; thence along Commercial Street to Broad Street; thencealong Broad Street to Mill Street; thence along Mil1 Street to Spring Street; thence along Spring Street to National Alley; thence along National Alley to Broad Street; thence along Broad Streetto Union Street; thence along Union Street to the point of beginning. (2) Fire Zone No. 2 shall include the territory outside of Fire Zone No. land bounded as follows: Beginniy phn db be of ain Street and the center of Deer Creek; thence from said point of beginning along the center lines of the following streets: along Main to Nevada Street; thence along Nevada Street to High Street; thence along High Street to Washington Street; thence along Washington Street to Coyote Street; thence along Coyote Street to Court Street; thence along Court Street to Main Street; thence along Main Street to Cottage Street; thence along Cottage Street to Broad Street; thence along Broad Street to Bennett Street; thence along Bennett Street to the center of Roger Willia ms Creek; thence along the center of Roger Williams Creek to the center of Deer Creek; thence along the center of Deer Creek to the point of beginning. (3) Fire Zone No, 3 shall include all territory within the city limits of the City of Nevada City which is not .contained in Fire Zones No, 1 and No, 2. Section 3. ADOPTION OF UNIFORM PLUMBING CODE, The Uniform Plumbing Code, 1958 Edition, together with the appendices thereto, as adopted by the Western Plumbing Officials Association, three copies of which Code, certified by the City Clerk to be true copies, are on file in the office of said City Clerk, ishereby adopted by reference as the Plumbing Code of the City of Nevada City, with the following amendments: (a) The first paragraph of Section 1.7 is deleted, (b) Part Two is deleted. Section 4, ADOPTION OF UNIFORM ELECTRICAL CODE AND NATIONAL ELECTRICALCODE, A primary code known as the Uniform Electrical Code, 1959 Edition, published by the Pacific Coast Electrical Bureau, anda secondary code known asthe National Electrical Code, 1959 Edition (1960 printing), as approved by the American Standards Association and adopted by the National Fire Protection Association and as adopted by reference in said primary code, three copies of each of which codes, certified by the City Clerk to be true copies, are on file in the office of said City Clerk, are hereby adopted by reference as the Electrical Codes of the City of Nevada City, with the following amendments: (a) Sections 10 and 11 of the Uniform Electrical Code are deleted. (b) Paragraph 2 of subsectionB of Section 6 of the Uniform Electrical Code is amended to read as follows: square feet of floor area or which is wired for an electric range, electric water heater, or electric clothes dryer, shall have a minimum of 100 ampere service supplied by three conductors not smaller than No, 2 AWG copper or equivalent in a raceway of a size conforming to Table 4 of this Code, with a service entrance distribution panel, and main switch, if such switch is installed, with a capacity of ! not less than 100 amperes, Such distribution panel shall ‘be designed to accommodate not less than eight branch circuit fuses or circuit breaker poles, so arranged that at least two three-wire branch circuits each of 50 ampere capacity can be provided. Section 5, BUILDING INSPECTOR, There is hereby established the office of Building Inspector of the City of Nevada City. The Building Inspector shall have all of the functions, powers, which are conferred upon the Building Official by the Uniform Building Code, upon the Administrative Authority by the Uniform Plumbing Code, and upon the Chief Electrical Inspector by the Uniform Electrical Code; and all references in said codes to the Building Official, the Administrative Authority and the Chief ElectricalInspector, respectively, shall be deemed to refer to the Building Inspector. Section 6. CONTRACT WITH COUNTY, In lieu of the appointment of a Build~} ing Inspector, the City may} contract with the County of Any dwelling over 900 « duties, and immunities: Nevada for the administration and enforcement by the County, within the City, of this Ordinance and the codes contract may transfer to the County any or all of the func= tions, powers and duties of and any board of appeals. Such contract may be authCity Council, Section 7, PUBLIC INSPECTION OF CODES, Three copies of each of the codeshereby adopted by reference, all certified by the City Clerk to be true copies thereof, shall be kept in the office of said Clerk for public inspection while this Ordinance is in force. Copies of said codes shall be made available by said Clerk for purchase by the public ata price not to exceed the actual cost thereof to the City. Section 8. COMPLAINCE WITH HEALTH AND ZONING REGULATIONS, No building permit shall be issued for any building for which an individual sewage disposal system must be installed, altered or added to, unless and until the Building Inspector is satisfied that a sanitation permit has been issued therefor by the County Health Officer, or his authorized representative. No building permit shall be issued unless and until the Building Inspector is satisfied that the construction authorized by the permit will not violate any existing zoning ordinances, Section 9. UTILIT Y CONNECTIONS, (a) It is unlawful for any person, including utility . companies, toconnect electric power lines or liquified petroleum gas sources permanently to any building or structure for which a permit isrequired by this Ordinance until the final inspection has been made and the approval signed by the Building Inspector, This section shall not prohibit the erection and use of temporary power poles approved bythe power company during the course of construction, (b) It is unlawful for any person to use or occupy any building or structure to which electrical power is served from a temporary power pole more than thirty (30) days following final inspection and approval of the building or structure by the Building Inspector. Section 10, PENALTIES FOR VIOLATION, Any person, firm or corporation violating any of the provisions of this Ordinance, or of the codes adopted hereby, is guilty of a misdemeanor and, upon'c onviction thereof, shall be punishable by a fine not exceeding five hundred dollars ($500) or by imprisonment not exceeding six (6) months, or by both such ‘fine and imprisonment. Section 11, REPEAL. OrNo, 221 and No. 280, and all other ordinances and parts of ordinances inconflict herewith, are hereby repealed, Section 12, EFFECTIVE DATE, This Ordinance shall take effect and be in force thirty (30) days after the date of its passage. Section 13, PUBLICATION. The City Clerk shall cause this Ordinance to be published once, within fifteen (15) days after its passage, in the Nevada County Nugget, a newspaper of general circulation published and circulated in the City of Nevada City. Section 2 (c) of Ordinance No, 286 is amended to read: 2(c). Toadopta sales and use tax ordinance which imposes an eight-tenths percent (0. 8%) tax and providesa measure therefor that can be administered and collected by the State Board of Equalization ina manner that adapts itself as fully as practicalto, and requires the least possible deviation from, the existing statutory and administrative procedures followed by the State Board of Equalization in administering and collecting the California State Sales and Use Taxes, Section 2. Section 4 (a) (1) of said ordinance is amended to read: 4 (a) (1). For the privilege of selling tangible personal property at retail a tax is hereby imposed upon all retailers inthe city at the rate of eight -tenths per cent (0.8) of the gross receipts of the retailer from the sale of all tangible personal property sold at retailinthe City of Nevada City on and after the operative date of this ordinance, Section 3, Section 5 (a) of said ordinance is amended to read: 5 (a). An excise tax is hereby imposed on the storage, use or other consumptionin the City of Nevada City of tangible personal property purchased from any retailer on or after the operative date of this ordinance, for storage, use or other consumption in the City at the rate of eight-tenths per cent (0.8%) of the sales price of the property. The sales price shall include delivery charges w hen such charges are subject to State sales or use tax regardless of the
place to which delivery is made, Section 4, This ordinance shall become operative on January 1, 1962, Section 5. This ordinance, inasmuch as it provides for a tax levy for the usual and current expenses of the City, shall, under the provisions of Section 1 of ArticleIV of the Constitution, and under the provisions of Section 861 (d) ofthe Municipal Corporations Act (Statutes 1883, page 93), take effect immediately.
