SUPPLEMENTAL INFORMATION
1. MITIGATION 1A: BUILDING AREAS SHALL BE LIMITED TO THOSE AREAS OUTSIDE OF THE IDENTIFIED
RESOURCE NON-DISTURBANCE AREAS UNLESS A MANAGEMENT PLAN IS FIRST APPROVED BY THE
PLANNING DEPARTMENT FOR ANY PROPOSED DISTURBANCE OF THOSE AREAS. SUCH SENSITIVE
RESOURCES INCLUDE STEEP SLOPES, LANDMARK OAK GROVES AND SEASONAL STREAM BUFFERS
IDENTIFIED ON THIS MAP AND IN THE BIOLOGICAL INVENTORY. DRIVEWAY CONSTRUCTION AND SEWAGE
DISPOSAL PLACEMENT FOR LOTS 2 AND 3 SHALL ADHERE TO THE MANAGEMENT PLAN REQUIREMENTS
IN MITIGATION MEASURES 4B AND 7B.
2. MITIGATION 4B MANAGEMENT PLAN: TO PROTECT WATER QUALITY IN THE INTERMITTENT DRAINAGE
AND DOWNSTREAM AQUATIC RESOURCES, THE CONTRACTOR SHALL IMPLEMENT STANDARD BEST
MANAGEMENT PRACTICES DURING AND AFTER CONSTRUCTION. THESE MEASURES SHALL BE
INCORPORATED IN ALL FINAL GRADING AND CONSTRUCTION PLANS AND WILL INCLUDE THE FOLLOWING:
A) PRIOR TO GRADING, CORRECTLY INSTALL SILT-FENCING, STRAW OR COIR LOGS OR ROLLS, OR
OTHER SEDIMENT BARRIERS TO KEEP ERODIBLE SOILS OUT OF THE INTERMITTENT DRAINAGE. BEFORE
THE FIRST HEAVY RAINS AND PRIOR TO REMOVING THE BARRIERS, SOILS OR OTHER SEDIMENTS OR
DEBRIS THAT ACCUMULATES BEHIND THE BARRIERS SHALL BE REMOVED AND TRANSPORTED AWAY
FROM THE DRAINAGES OR PONDS FOR DISPOSAL. B) DISRUPTION OF SOILS WITHIN THE INTERMITTENT
STREAM SHALL BE MINIMIZED; DISTURBED AREAS SHALL BE GRADED TO MINIMIZE SURFACE EROSION
AND SILTATION TO THIS FEATURE; BARE SOILS SHALL BE IMMEDIATELY STABILIZED AND REVEGETATED.
SEEDED AREAS SHALL BE COVERED WITH BROADCAST STRAW OR MULCH, ANCHORED JUTE NETTING, OR
BIODEGRADABLE EROSION CONTROL BLANKETS, DEPENDING ON THE SLOPE GRADIENT. C) THE
CONTRACTOR SHALL EXERCISE EVERY REASONABLE PRECAUTION TO PROTECT THE INTERMITTENT
DRAINAGE AT (AND ADJACENT TO) THE PROJECT SITE FROM POLLUTION WITH FUELS, OILS, BITUMEN,
CALCIUM CHLORIDE, AND OTHER HARMFUL MATERIALS. CONSTRUCTION BYPRODUCTS AND POLLUTANTS
SUCH AS OIL, CEMENT, AND WASH WATER SHALL BE PREVENTED FROM DISCHARGING INTO THE
STREAM AND SHALL BE COLLECTED AND REMOVED FROM THE SITE. NOR SHALL ANY SLASH OR
OTHER NATURAL DEBRIS BE PLACED IN OR ADJACENT TO THIS FEATURE. ALL CONSTRUCTION DEBRIS
AND ASSOCIATED MATERIALS AND LITTER SHALL BE REMOVED FROM THE WORK SITE IMMEDIATELY UPON
COMPLETION.
3. MITIGATION 7A LANDMARK OAK GROVES: THE NON-DISTURBANCE OPEN SPACE AREA SHALL BE
MAINTAINED BY THE PROPERTY OWNER SO AS NOT TO REDUCE THE SIZE OF THE TREE CANOPY AND
TO PRESERVE THE NATURAL BIOLOGICAL HABITAT. THERE SHALL BE NO CONSTRUCTION, GRADING,
DISTURBANCE, OR CHANGE IN NATURAL RUNOFF WITHIN THE DESIGNATED NON-DISTURBANCE OPEN
SPACE AREA, EXCEPT AS PROVIDED FOR IN THE MANAGEMENT PLAN MITIGATION MEASURES IN
MITIGATION MEASURE 7B. EXCEPTIONS MAY BE ALLOWED SUBJECT TO APPROVAL BY THE PLANNING
DIRECTOR, PRIOR TO ANY SITE DISTURBANCE, PROVIDED A CERTIFIED PROFESSIONAL ARBORIST,
LICENSED LANDSCAPE ARCHITECT, OR A PROFESSIONAL FORESTER IDENTIFIES ONE THE FOLLOWING: A)
DISTURANCE NECESSARY FOR MAINTAINING ADEQUATE FIRE PROTECTION. B) DISTURBANCE NECESSARY
TO MAINTAIN THE HEALTH OF THE BIOLOGICAL COMMUNITY. C) DISTURBANCE NECESSARY TO REMOVE
DEAD OR DYING TREES, OR THOSE TREES DETERMINED TO BE A PUBLIC SAFETY HAZARD. D)
SELECTIVE TIMBER HARVEST PURSUANT TO AN APPROVED TIMBER HARVEST PLAN FROM CDF.
4. MITIGATION 7B MANAGEMENT PLAN: TO MINIMIZE INDIRECT IMPACTS TO OAKS ASSOCIATED WITH
DRIVEWAY CONSTRUCTION AND SEWAGE DISPOSAL SYSTEM PLACEMENT ON LOTS 2 AND 3, THE
FOLLOWING MITIGATIONS SHALL BE INCORPORATED INTO ANY FUTURE GRADING/CONSTRUCTION PLANS:
A) ESTABLISH THE LANDMARK OAK GROVES AS ESA’S (ENVIRONMENTALLY SENSITIVE AREAS) DURING
CONSTRUCTION. THE BOUNDARY OF THE OAK ESA’S SHALL BE ESTABLISHED AT THE DRIPLINE OF
THE OAKS OR OAK GROVES. THE ESA BOUNDARIES SHALL BE SHOWN ON ALL CONSTRUCTION PLANS
AND SPECIFICATIONS. B) PLANS AND SPECIFICATIONS SHALL CLEARLY STATE PROTECTION PROCEDURES
FOR OAKS TO BE PRESERVED ON THE PROJECT SITE. THE SPECIFICATIONS SHOULD ALSO REQUIRE
CONTRACTORS TO STAY WITHIN DESIGNATED WORK AREAS AND SHALL INCLUDE A PROVISION FOR
PENALTIES IF OAK TREES ARE DAMAGED. C) NO VEHICLES, CONSTRUCTION EQUIPMENT, MOBILE
OFFICES, OR MATERIALS SHOULD BE PARKED OR LOCATED WITHIN THE DRIPLINES OF OAKS AND
OTHER HARDWOODS THAT ARE TO BE PRESERVED. D) SOIL SURFACE REMOVAL GREATER THAN ONE
FOOT SHALL NOT OCCUR WITH THE DRIPLINES OF OAKS TO BE PRESERVED. NO CUTS OR
TRENCHING SHALL OCCUR WITHIN THE DRIPLINE. iF THIS AREA CANNOT BE AVOIDED, THEN THE TREE
SHALL BE ADDED TO THE LIST OF OAKS 70 BE REPLACED THROUGH AN ON-SITE PLANTING. £)
EARTHEN FILL GREATER THAN ONE FOOT DEEP SHALL NOT BE PLACED WITHIN THE DRIPLINES OF OAK
TREES TO BE RETAINED, AND NO FILL SHALL BE PLACED WITHIN FIVE FEET OF THEIR TRUNKS,
EXCEPT FOR THOSE TREES MARKED FOR MITIGATION. F) PAVING SHOULD NOT BE PLACED WITHIN THE
DRIPLINES OF OAKS TO BE RETAINED. G) UNDERGROUND UTILITY LINES TRENCHING SHALL NOT OCCUR
WITHIN THE DRIPLINES OF OAKS TO BE RETAINED. IF IT IS ABSOLUTELY NECESSARY TO INSTALL
UNDERGROUND UTILITIES WITHIN THE DRIPLINES OF OAK TREES, THE TRENCH SHALL NOT BE DUG
WITHIN FIVE FEET OF THE TRUNK. THE TRENCH SHALL BE DUG BY HAND IN THE VICINITY OF THE
DRIPLINE, AND ROOTS SHALL BE AVOIDED.
5. MITIGATION 7C NESTING BIRDS: A) TREE REMOVAL SHALL NOT TAKE PLACE DURING THE BREEDING SEASON
(MARCH {-JULY 31). B) IF TREE REMOVAL MUST OCCUR DURING THE NESTING SEASON, SURVEYS FOR
NESTING RAPTORS AND MIGRATORY BIRDS ARE REQUIRED PRIOR TO ANY CONSTRUCTION-RELATED ACTIVITIES
OR OTHER SITE DISTURBANCES INITIATED DURING THE BREEDING SEASON. C) AN ADDITIONAL SURVEY MAY BE
REQUIRED IF PERIODS OF CONSTRUCTION INACTIVITY (E.C., GAPS OF ACTIVITY DURING GRADING, TREE
REMOVAL, ROAD BUILDING, OR STRUCTURE ASSEMBLY) EXCEED A PERIOD OF THREE WEEKS, AN INTERVAL
DURING WHICH BIRD SPECIES, IN THE ABSENCE OF HUMAN OR CONSTRUCTION RELATED DISTURBANCES, MAY
ESTABLISH A NESTING TERRITORY AND INITIATE EGG LAYING AND INCUBATION. D) SURVEYS SHALL BE
CONDUCTED NO SOONER THAN TWO WEEKS PRIOR TO THE INITIATION OF CONSTRUCTION ACTIVITIES OR
OTHER SITE DISTURBANCES. E) SHOULD ANY ACTIVE NESTS OR BREEDING AREAS BE DISCOVERED, A BUFFER
ZONE (PROTECTED AREA SURROUND THE NEST) AND MONITORING PLAN, IF NEEDED, SHALL BE DEVELOPED.
NEST LOCATIONS SHALL BE MAPPED AND SUBMITTED, ALONG WITH A REPORT STATING THE SURVEY RESULTS,
TO THE NEVADA COUNTY PLANNING DEPARTMENT WITHIN ONE WEEK OF SURVEY COMPLETION. A QUALIFIED
WILDLIFE BIOLOGIST SHALL MONITOR THE PROGRESSION OF REPRODUCTIVE STAGES OF ANY ACTIVE NESTS
UNTIL A DETERMINATION IS MADE THAT NESTLINGS HAVE FLEDGED AND THAT A SUFFICIENT TIME FOR
FLEDGLING DISPERSAL HAS ELAPSED; CONSTRUCTION ACTIVITIES SHALL BE PROHIBITED WITHIN THE BUFFER
ZONE UNTIL SUCH DETERMINATION IS MADE.
6 MITIGATION 7D: TO PROTECT THE AGRICULTURE AND DOMESTIC USE OF THIS PROPERTY WHILE STILL
FACILITATING THE FREE MOVEMENT OF WILDLIFE, NO SOLID FENCE SHALL BE PLACED ON ANY LOT EXCEPT
AROUND THE SINGLE-FAMILY DWELLING, CULTIVATED AREAS AND ANIMAL ENCLOSURES, PERIMETER FENCING
SHALL BE LIMITED TO THREE OR FOUR STRAND, BARBED-WIRE TYPE, OPEN MATERIAL.
7, MITIGATION 15A CULTURAL RESOURCES: ALL CONSTRUCTION PLANS SHALL ADVISE CONTRACTORS AND
CONSTRUCTION PERSONNEL INVOLVED IN ANY FORM OF GROUND DISTURBANCE, I.E. UTILITY PLACEMENT OR
MAINTENANCE, GRADING, ETC., OF THE REMOTE POSSIBILITY OF ENCOUNTERING SUBSURFACE CULTURAL
RESOURCES. IF SUCH RESOURCES ARE ENCOUNTERED OR SUSPECTED, WORK SHALL BE HALTED
IMMEDIATELY AND THE PLANNING DEPARTMENT CONTACTED. A PROFESSIONAL ARCHAEOLOGIST SHALL BE
CONSULTED TO ACCESS ANY DISCOVERIES AND DEVELOP APPROPRIATE MANAGEMENT RECOMMENDATIONS FOR
ARCHAEOLOGICAL RESOURCE TREATMENT. IF HUMAN BONE IS ENCOUNTERED, CALIFORNIA LAW REQUIRES
THAT THE NEVADA COUNTY CORORNER AND THE NATIVE AMERICAN HERITAGE COMMISSION BE CONTACTED
AND, IF NATIVE AMERICAN RESOURCES ARE INVOLVED, NATIVE AMERICAN ORGANIZATIONS AND INDIVIDUALS
RECOGNIZED BY THE COUNTY SHALL BE NOTIFIED AND CONSULTED ABOUT ANY PLANS FOR TREATMENT.
8. A ROAD IMPROVEMENT FEE IN ACCORDANCE WITH NEVADA COUNTY ORDINANCE NO. 1829, CREATING AND
ESTABLISHING THE AUTHORITY FOR IMPOSING AND CHARGING A ROAD IMPROVEMENT FEE WITH THE
UNINCORPORATED TERRITORY OF NEVADA COUNTY, WILL BE LEVIED AT THE ISSUANCE OF BUILDING PERMITS
FOR EACH PARCEL CREATED BY THE MAP, AND WILL BE BASED ON THE LATEST FEE SCHEDULE ADOPTED BY
THE NEVADA COUNTY BOARD OF SUPERVISORS.
9, THESE PARCELS ARE WITHIN THE BOUNDARIES OF COUNTY SERVICE AREA 12 AND ARE ASSESSED AN
ANNUAL PARCEL CHARGE TO PROVIDE FOR ONGOING ROAD MAINTENANCE.
10, THERE IS NO GUARANTEE THAT SEWAGE CAN BE DISPOSED OF ON ANY LOT OR PARCEL OF THE
RECORDED MAP. THERE IS NO GUARANTEE THAT WATER IS AVAILABLE ON ANY LOT OR PARCEL ON THE
RECORDED MAP.
11. PRIOR TO ANY FINAL OCCUPANCY FOR ANY NEW CONSTRUCTION ON THIS MAP, VEGETATION CLEARANCE
AROUND STRUCTURES SHALL MEET THE MINIMUYM REQUIREMENTS OF PUBLIC RESOURCES CODE SECTION
4291. STRUCTURES SHALL MAINTAIN A FIRE BREAK BY REMOVING AND CLEARING AWAY ALL BRUSH,
FLAMMABLE VEGETATION OR COMBUSTIBLE GROWTH UP TO 100 FEET FROM STRUCTURES OR TO THE
PROPERTY LINE, WHICHEVER IS CLOSER. CLEARING DOES NOT APPLY TO INDIVIDUAL ISOLATED TREES,
ORNAMENTAL SHRUBBERY OR SIMILAR PLANTS WHICH ARE USED FOR GROUND COVER UNLESS SUCH
VEGETATION FORMS A MEANS OF RAPIDLY TRANSMITTING FIRE FROM GROUND VEGETATION TO CANOPY TREES.
ADDITIONAL CLEARING MAY BE REQUIRED BY THE FIRE MARSHALL IF EXTRA HAZARDOUS CONDITIONS EXIST.
