NOTES AND DEFINITIONS:
1. THE TERM “UNIT" SHALL MEAN AND REFER TO A UNIT AS DEFINED IN SEC. 1351 (f) OF THE CIVIL CODE THAT
PORTION OF ANY CONDOMINIUM WHICH IS NOT OWNED IN COMMON WITH OTHER OWNERS, AND WHICH IS
DESIGNATED AS A UNIT IN A CONDOMINIUM PLAN. THE BOUNDARIES OF A UNIT, AS DESIGNATED IN SEC. 1351 (e) OF
THE CIVIL CODE, ARE DESCRIBED AS ALL INTERIOR SURFACE COVERINGS INCLUDING BUT NOT LIMITED TO
WALLPAPER, PAINT, PANELING AND FLOOR COVERINGS, AND ALL DOORS AND WINDOWS OF A UNIT AND ALL FIXTURES
AND UTILITY INSTALLATION LOCATED WITHIN THE UNIT, INCLUDING, WITHOUT LIMITATION, HOT WATER HEATERS
AND LIGHTING FIXTURES, SHALL BE PART OF EACH UNIT. PROVIDED FURTHER, THE AREA ABOVE FURRED-DOWN
CEILINGS SHALL NOT BE A PART OF SUCH UNIT.
2. IN INTERPRETING DEEDS AND PLANS, THE EXISTING PHYSICAL BOUNDARIES OF A UNIT, OR OF
A UNIT RECONSTRUCTED IN SUBSTANTIAL ACCORDANCE WITH THE CONDOMINIUM PLAN, SHALL
BE CONCLUSIVELY PRESUMED TO BE ITS BOUNDARIES, RATHER THAN THE METES AND BOUNDS
OR OTHER DESCRIPTION EXPRESSED IN THE DEED OR CONDOMINIUM PLAN, REGARDLESS OF SETTLING
OR OF LATERAL MOVEMENT OF THE BUILDING OF WHICH THE UNIT FORMS A PART, AND REGARDLESS
OF CHANGE OR CHANGES IN PHYSICAL BOUNDARIES WHICH MAY HEREAFTER EXIST IN THE EVENT SAID
UNIT AND BUILDING OF WHICH THE UNIT FORMS A PART IS RECONSTRUCTED IN SUBSTANTIAL
ACCORDANCE WITH THE CONDOMINIUM PLAN AND REGARDLESS OF MINOR VARIANCES BETWEEN THE
PHYSICAL BOUNDARIES SHOWN ON THE CONDOMINIUM PLAN OR IN THE DEED AND THOSE OF THE BUILDING.
3. LOT "A", "COMMON AREA & P.S.E.", SHALL MEAN THE ENTIRE PROJECT EXCEPT ALL UNITS DEFINED AS LOT . . THE
"COMMON AREA AND P.S.E. " AS DELINEATED SHALL BE DEDICATED TO THE CITY OF GRASS VALLEY FOR PUBLIC
SERVICE PURPOSES ONLY, APPURTENANT TO THE PROJECT, SAID RIGHTS SHALL OVERRIDE ALL OTHER USES WITHIN
SAID "COMMON AREA & P.S.E."
THE TERM "COMMON AREA" AS DESIGNATED AND ENTIRELY WITHIN LOT . SHALL BE OWNED IN COMMON WITH
OTHER OWNERS.
4. THE SIDELINES OF ALL UNITS INTERSECT AT RIGHT ANGLES (90°) UNLESS OTHERWISE NOTED.
5. IN INTERPRETING PLANS AND DEEDS FOR THE HEREON SHOWN CONDOMINIUM UNITS, THE ACTUAL PHYSICAL
LOCATION OF THE UNIT BOUNDARIES SHALL BE UNDERSTOOD TO DEFINE THE LEGAL LIMITS OF THE UNIT,
SUPERCEDING THE DIMENSIONS SET FORTH ON THE HEREON SHOWN CONDOMINIUM PLANS.
