To avoid impacts to nesting raptors and migratory birds the following are required to ensure the proper and timely implementation of all mitigation measures contained in this report. as well as the terms and conditions of any other required permits. the applicant shall distribute copies of these mitigation measures and permit requirements to the contractor prior to grading and construction. The contractor or a designated crew supervisor shail be on site any time construction occurs near the drainage. This person shall be completely familiar with the mitigation measures contained above and with the terms and conditions of all permits. a. Grading. construction. and vegetation removal should be avoided during the nesting season CMarch 1 — July 31>. If construction activities cannot be avoided during the nesting season. pre-construction surveys shall be conducted to verify that the construction and potential disturbance zones do not support nesting migratory birds. b. Tree removal shall not take place during the breeding season CMarch 1 — July 31). unless supported by a report from a qualified biologist to verify that birds. including raptors. are not nesting in the trees proposed for removal or disturbance. c. An additional survey may be required if periods of construction inactivity Ce.g. gaps of activity during grading, tree removal. road building. or structure assembly) exceed a period of two weeks. an interval during which bird species. in the absence of human or construction-related disturbances, may establish a nesting territory and initiate egg laying and incubation. d. Surveys shall be conducted no sooner than two weeks prior to the initiation of construction activities or other site disturbances. e. Should any active nests or breeding areas be discovered. a buffer zone Cprotected areas surrounding the nest. the size of which is to be determined by a qualified biologist) and monitoring plan shall be developed. Nest locations shall be mapped and submitted. along with a report stating the survey results. to the Nevada County Planning Department within one week of survey completion. A qualified wildlife biologist shall monitor the progression of reproductive stages of any active nests discovered during the pre-construction survey until a determination is made that nestlings have fledged and that a sufficient time for fledgling dispersal has elapsed; construction activities shall be prohibited within the buffer zone until such determination is made. 12. 12. 14. 15. 16. Hours of operation for construction activities requiring improvement. grading or construction plans shall be limited to the hours of 7:00 a.m. ta, G:00 p.m. M-Sat. Plans shall reflect these limited hours of operation and shall be reviewed by the Planning Department prior to permit issuance. All above ground structures must be placed within the building envelopes identified on the Supplemental Map. Prime Farmlands and Farmlands of Local Importance are delineated on the Supplemental Map to ensure that future property owners are aware of the resource. Contractors and construction personnel involved in any form of ground disturbance Cie. utility placement or maintenance. grading, etc.) shall be advised of the remote possibility of encountering subsurface cultural resources. If such resources are encountered or suspected. work shall be halted immediately. and the Planning Department and a professional archaeologist shall be consulted who shall assess any discoveries and develop appropriate management recommendations for archaeological resource treatment. If bones are found and appear to be human. California Law requires that the Nevada County Coroner and the Native American Heritage Commission be contacted. If Native American resources are
    involved, Native American Organizations and individuals recognized by the County shall be notified and consulted about any plans for treatment. A Road Improvement Fee in accordance with the Nevada County Ordinance No. 1829. creating and establishing the authority for imposing and charging a Road Improvement Fee with the unincorporated territory of Nevada County. will be levied at the issuance of building permits for each lot created by the map. and will be based on the latest fee schedule adopted by the Nevada County Board of Supervisors. ° 17. 18. 14. 20. 21. 22. There is no guarantee that water is available on any lot or parcel on the recorded map. Prior to any occupancy. vegetation clearance around structures shall meet the minimum requirements of Public Resources Code Section 4291. Structures shall maintain a firebreak by removing and clearing away all brush. flammable vegetation or combustible growth no less than 100’ from structures or to the property line. whichever is closer. Such clearing does not apply to individual isolated trees. ornamental shrubbery or similar plants. which are used for ground cover unless such vegetation forms a means of rapidly transmitting fire from ground vegetation to canopy trees. Replacement vegetation should be ornamental shrubbery of the fire safe varieties. Additional clearing may be required by the Fire Marshal if extra hazardous conditions exist. All flammable vegetation and fuels caused by site development shall be legally disposed or removed. Nevada Irrigation District reserves the right to access facilities by a route of least inconvenience to the owner. NID will utilize the natural drainage canal shown as “overflow ditch” on sheet 3 of this map from time to time for various overflows and flushing purposes. The pond is required to contain a minimum of 4000 gallons of water for fire protection at all times and all plumbing shall be maintained in good operating condition.
