The Agt of the last Legislature,
known as the Senatorial Apportionment Bill, does not. take effect
until July 1, 1886, the object being
. the revolutionary purpose of retaining the Senators elected from the udd
nuinbered districts in their seats four
years, in plain violation of the Constitution. The Constitution fixes the
terms of Senators at four years, and
siys that the seats of twenty Senators elected in the year 1882, from
the odd numbered districts, shall be
vacated at the end of the second
year, so that one-half of the Senators
shall be elected every two years,”
A subsequent section, after providing a method of apportionment, says:
' “Until such districting as herein
provided for shall be made, Senators and Assemblymen shall be elected by the districts according to the
apportionment now provided’ by
law.” ‘There is not the slightest ambiguity about these provisions of the’
Constitntion. ‘Untilsuch districting is provided for, Senators shall be
elected by the districts according to
the apportionment now provided by
aw.” A full Senate of forty members was elected in 1882, and, if the
Constitution means anything, those
elected from odd numbered districts
can hold only for two years. Under
the apportionment law then and still
in force are twenty-nine Senatorial
districts, fifteen of which are odd
numbered, from which twenty Senators were chosen at the election of
1882—eighteen Democrats and two
Republicans: The question now is,
will the people submit to a_ plain
lation from any stress of common
necessity, but simply that a political
party may gain a partisan advantage
of its oponents ? It is. certainly a
_most dangerous precedent to establish, and one, if insisted upon may
lead to the direst consequences.
Senator Hill, of the Salinas Index,
in an able and suggestive editorial
upon the subject says: .
“The revolutionary course pursued
by the Democrats will, in our judgment, result in the introduction of
mome étirring scenes into the politics of California. If the Republicans should happen to carry the Assembly in 1884—a by no means _improbable event—and ignoring, as
they doubtless would, the attempt
to continue twenty Senators in office
after their constitutional term had
expired, should elect twenty successorsin the odd numbered districts,
who would be recognized by the Republican hold-overs andthe Republican Assembly, and so constitute a
Republican Legislature, what would
be the situation? It is not a satisfactory answer to this question to
say that a decision of the Supreme
Court could be obtairied. before. the
election, which would settle the
matter and avoid any such complication, As the Constitution is invested the Legislature with the power
of determining the election and
the qualification of its members, a
Republican Legislator might not see
fit to surrender that function to a
Democratic Supreme Court.
The willingness which the Democratic party so often manifests to unsettle everything for the prospect of
partisan advantage is what causes conservative people generally to view it
with distrust. Menofmoderate views
do not luok with any degree of complacency upon the prospect of public
turmoil and disturbance; nor do they
like the course of a party which
seems willing to risk it for some
small advantage to itself. -We believe that this feeling will array the
great conservative forces of the
country against the Democratic party in the next Presidential election, . .
