SLICKENS. Granger Justice on the Half Sheli— Another Skirmish. The Marysville Appeal of Sunday says: The cases of Yuba County vs. the Eureka ‘Lake,* Blue Tent and Yuba River Gold Washing hydraulic mining companies came up in the Superior Court yesterday. «Judge Blanchard of Colusa. presided. Plaintiff was represented. by Richard Bayne and E. A. Davis, Nile Searls and J. K. Byrne appearing for the defendants. Argument was made on an order to show cause why th: returns of service of summons as to each of the companies defendant should not be set aside. Plaintiff's attorneys admitted,, at the outs+t, imperfect service in the case of. the’ Yuba RiverGold Washing company, and the return of service as to that defendant was accordingly aunulled by Court. After vhe points involved in the question of service on th: other two companies had been argued for upwards of two hours, the Court found the service sufficient, avd dismissed the order to show dause why the returns of service a: aforesaid: should not be vacated. The attorneys for the defendants were allowed ten days to file a bill of exceptions to this ruling, and were :also allowed fifteen days tc plead. The injunctions issued in these cases remain, of course, in. force, : The Blue Tent and the Yuba River Gold Washing companies are both London corporations. The Kurek» Lake company is incorporated in New York. An Act of the Legislature, approved April 1, 1872, provides that foreign, or quasi-foreign corporations, doing business in this . , State, shall file in the office of the . . Secretary of State a paper desig. nating some resideat upon whoin process shall be served in any legal proceeding against the company. (Statutes 71-2, page 826). In conformity with this Act the Blue Tent company had thus designated Thomas Price, and the Eureka Lake company had designated David Cahn, at the persons upon whom legal process against those companies should be served, Service of summons in th: therefore made on the persons fendants founded their arguments on Section 411—sub, 2 oft he Code ot! Civil Procedure, which reads as follows: “If the suit is against a foreign corporation, or a non-resident joint stock company or association doing business and having a managing or within this State [service shall be made] to such agent, cashier or secretary,” “ The defendants’ attorneys contended uader the foregoing that service upon Cahn.and Price should be set-aside, an they are not, and have not been, either agents, cashiers or secretaries -of the aforesaid companies. Hence the argument that the statute was repealed by the adoption of the Code, could not:be sound; Compliance with either the provisions of the Code or of the statute is sufficient, they argued, for purposes: of servige. _ Judge Searls, in the course of his arguments for the defendants, referred to the statement in Cahn’s affidavit that A. S. Bigelow is agent and superintendent for ‘the Eureka} Lake company, said that Mr. Bigelow could always be;found at Columbia Hill, Nevada county, and tha servict should have been aye on him, “If you wille: excuse the interruption,” broke in Mr. Davis, ‘I will remark that the Sheritf of Neviida county followed the trail of Mr. Bigelow through the mountains, for three days, and finally lost it. The papers for service on Mr. Bigelow were in the hands of the.
