When Judge Sawyer prepared the
decree which isso sweeping in’ its
character, the counsel of the miners
went before him and asked for a
modificatiuns so that the decree
‘ should only apply to hydraulic mining, as that is ‘all the complaint
asked.for, The couasel read to the
Judge the words of Cadwalader (as
above), ‘disclaiming any attack upon
any other than’ hydraulic mining,
and asked that the dec'ee should be
‘modified to conform to it, so that
drift and quartz mining might be al;
lowed to cdntinue.

Cadwalader, notwithstanding his
statements in the record as apears above, and we regret to say
that the Judge made the decree so
' absolute and'severe as to prohibit the
sale of water.to any mine.of any
