te CONCHESS.— The Thirty-uinttr Con . pore y the owners of the gress of the United States will meet in its firs avion, on’ the 4th day ot Devoiiber— ~ one woek ‘from next Monday. ti assemble 2 od the formation of the Guyernment; cAll the -questiogs Of reednsti-iction in the rebel States will no doubt be . puibunlb tad 40 that, body by the. President.— = He-has r oh a the States lately ih te~“bellion tha oastitutions-must be submitted to ae fe for appreval, ic . . dng the responsibility of ‘providing Be at reballion and diseo¥d inthé future upon the ‘Legislative department of the nation. All of ‘the. Presidents acts since the close of the rebellion, have been based, not upon any law,-batapot the necessity of the case. He has been acting, not as the executive of the nation, but asthe military head + When the rebel government was broken uj “up and their'armies defeated, tre States were left: without government, aud as: military: ¢om~~ mander, holding the territory as such, the President.was under. the negessiiy of appointing rulers and regulating affairs until sonie competent legislative authority should _ assemble. That authority rests in Congress “and the ei germane. that body, will tell for weal or woe upon future of thew “what Pigaidieut "rohoadl holds this view of the question is demonstrated by his acts By! what authority does he appoint Govern« Ota hid other officers if the rebel States, if not by virtue of bi position of Commanderin Chief of the: Army, and where does be ge} the authority to ‘prescribe laws for those States, if not fi a the same source? Does the, Constitution.giye him powerte make laws as well as execute them? Certainly not, and yet even the most bitter, opponent of Johnson does not pretend to say that he has exceeded his powers in the appuintment » of Provisional Governors in rebel States.— In yielding this. point, all parties »cknowledge that the rebel States are held by vir, tug pf thé war power of the sation, though they may call it by other names. . The rebel States are now in precisely the same Gon~ _»@ition, they, oecupied when the rebel armies were disbanded. ‘True, they have held conventions and adopted constitutions, and in some instonces elected offices under their ametided constitutions. The President has told them that these instruments must be ‘subinitted to Corgress. Suppose’ that body should reject them, what would become of the elections and the State organizations _ which the late rebels have, in part, perfect“ed? The President's policy leaves the whole Matter at the disposal of Congress, and uotil the action of the late rebels 1s ratified by ‘that ‘body they will have accomplished : snothing..'This view of the. case, will leave the admission of Representatives to Congress from the Suuthern States also to that, body. ‘Let us take'for instance South Carolina. That State goes to work and sapende . her constitution, and under that instrument elects nibnibers of Congress. No Representative can be admitted until the instrument is ratified, and even after it is aéceépted by In its results Congress,. that; body .can pass upon the: claims of persons chosen toa seat, Considerpble bas heen said in regard to the proba. (5 _ bility that the names of Representatives of the late rebel] States will be called by the . -@lerk of the House. Whattight has he to call theirnumes anti? the State which they claim to represent is orgunized ? As we stated ut the outset of this artic New ‘the President has shiwh by his acts that he considers the whol: question of reconstruction ac a matter for the decerminativn of, eka nad unless his theary difle s very materially from his practice, we expect that he will tke this ground in his M seage! tn . > ‘this view of the case, the dupreceitid responsibility resting upon the next Congress will.be readily perceived.
