This provision of the new constitution was, of course, intended to aid the borrower by compelling the party making a loan secured by a mortgage on real estate to pay the taxes on the amount of the loan, that amount being deducted from the asuetsment of the property securing the loan. “The mortgage tax has so far failed of its purpose that it has not only made it more difficult fur the borrower to obtain a loan on his land, but has actually, to some extent, meréased the rate of interest by ‘turning to other States ties capital . Col. Edwards Woodraff, in ‘aipwer to what legislation is needed: for this part of Yuba county, replied: “The waters of the Yuba river are now. flowing down surcharged with mountain mud, so thick that you can almost cut it with a knife, and that no faith can possi bly be given to the honesty of hydraulic mining or of hydraulic mining promises, and that therefore the existence of the navigable rivers and the great Sacramento Valley is not possible with the continued existence of hydraulic mining in any form or shape. The‘ latter has been tried in every way and fdrm of rehabilitation and has proven the deadly enemy and déstroyer of our rivers and valleys. It cannot be otherwise.
