SOME RECENT RULINGS
By the Secretary of the Interior on Mineral
*. Land Entries.
Proof of the mineral character of land
must be specified and based upon the actual production of mineral. It is not
enough to show that weighboring or adjoining tands are mineral in their character avd that the lands in controversy
may hereafter develop minérals” to “such
an extent as to show their mineral character, but it must be shown, as a present
‘existing fact, that the lands in question
are .wineral, and this must appear from
actual proauction of mineral, and not
from a theory that the lands miy hereafter produce minerals.
While it may be true, as contended,
that the Circuit Court for the Ninth
Jacicial Circuit has gone to the extent of
ho.ding ‘that the right of the railroad
company attaches to mineral lands, unless there are. known mines thereon, at
date of definite location of the road, yet
I am unwilling to accede to the contention that the Supreme Court has so decided.
The discovery of the mineral character
of land at any time prior to the issuance
of a patent therefor excludes such lands
from the grant to the railroad company.
