Reminiscences of Early days in the
region of Foster’s Bar, Yuba County,
California.
In closing my reminiscences of the Stew
‘art and Berdue matter, I promised to give to
the readers of the Puss. at some future time,
the history of one of the most diabolical and
‘outrageous murders ever committed in this
‘State. Having some leisure time to devote
‘to. this subject, and in pursuance of my prom‘ise, Lherewith furnish you with a full and
‘succinct statement of
THE MURDER OF JOHN DASCHER,
who came to his death early in the year 1851,
by the hands of De Witt Clinton Shattuck.
Dascher was a German or Swede by birth,
and was known as a qniet, inoffensive man.
Shattuck was a native of the State of Michigan. Hlewas gentlemanly in his manners, .
well educated, and, to all appearanves, one
of the most amiable men J ever knew. But,
to my story:
In the fall of the year 1850, John Dascher,
De Witt C. Shattuck and Henry Hf. H. Adriance, or Adriants, emigrated from Calaveras
county. and located themselves in a canon a
short distance below Winslow’s Barjon the
. Yuba River, at which place they continued
the business of mining, until the menth of
May, 1851. They bad long been mining together in Calaveras county, and had formed
amutual attachnrent for each other—so
much so that the zei?/ of one was the will of
all.
In May, 1851, Adriance was dispatched to
Foster’s Bar for the purpose of prospecting,
and if possible of securing a mining claim at
that place for the company, the mines at
Foster's Bar at that time being in very good
repute. Adriance agreed to undertake the
task assigned him, promising tu return the
same evening and makea report. He came
to Foster’s (where the writer of this remimiscence met him forthe first tame) ona Sunday, and teceived from me due information
‘as to the valae of the mining claims there,
and abso of such claims as were uaoccupied.
I furnished him with pan, shovel and pick to
prospect the ground, which he did, and
which proved satisfactory. In the evening
of the same day he returned to his camp.
A few days afterwards he returned to Poster’s in company with Shattuck. They commenced working the claims located by Adriance, and continued to work thereon. for
about one month, when they again took their
departure for their old location below Winslow’s.
I saw these men every day whilst at Foster’s Bar—had numerous business transactions with them, and had formed a very favorable opinion of them—particularly (owards Shattuck. lsaw no more of these
men, or cither of them afte: they left Foster's,
until one day, the 2d of July, 1351, having
some business in the Court of Sessions o!
Marysville, . was surprised on looking ata
jury which was about being empancled, to
see Adriance among the number. The jury
was duly empaneled—Adriance having been
chosen one—after which the court took a recess till 2 o'clock, P. M.
Adriance followed me out of the Court
House, asked me to detain a moment till everybody had gone out of bhearing—saia he
had something particular to tell me; that
his life was in danger, and that he knew not
how soon he would be launched into eternity. That be was watched; his life tureatened, and that he was almost distracted. He
acted more like a mad or crazy man than a
sine one, and [ verily believed bim to be in
sane. I quieted his fears and apprehensions
by assuring bim that no one should injure
him, that I would protect him, etc., and
asked him to unburthen bis mindto me. He
replied, “ not for worlds would I do it here,
everybody is looking at us; it is death to
me'to sce me talkingto you now ; I shouldn’t
wonder if I get killed before half an hour.”
Finding that I could get nothing from him.
I made an appointwent with bim to meet me
in half an hour at my room in the old U.S.
Hotel, and: parted company with him.
At the time appointed he was closeted
‘with me in my room, where he gave me in
‘detail the facts connected with the murder
of Dascher, and which I will give hereafter
in his own language, as sworn to by him before the Justice of the Peace at Foster’s Bar,
‘on the examination of Shattuck, charged
witb the erime of murder.
He told me that he had not slept a wink
at night for more than two weeks. that he
was trying to run away from bis own
thoughts, that his life was ofe continued
torment to him; that for nearly a month he
had been trying to escape from Shattuck,
dut that the latter, night and day, watched
‘him likea hawk. Said that two days pre‘vious to meeting me at Marysville, he had
*prevailed on Shattuck to permit him to go
‘prospecting ; that instead of doing so, be
struck out across the country to Bidwell’s
‘Bar with the intention of going to Shasta,
‘and from thence to Oregon, so as to get completely out of the way of Shattuck, who he
‘believed would kill him at sight.
He said that at Bidwell’s Bar his conscience
smote him, tbat. he could pot eai, drink or
sleep, and that he suffered such mental anguish that be was induced to unburthen his
mind to a lawyer at that place (Pat. Harris,
I think), who advised bim to return to Marysville and relate the matter to the authorities of that county. His words, bis conduct,

‘me of one of two things, Viz:
Ist. That be was crazy; or, .
2d. That if there was a murder commit‘ted, he was the guilty party. ,
I determined to probe the matter to the
dottom, however, and if the crime had been
: duly deputed for that service.

. committed, to bring the murdererto a jus
punishment, and thereupon procured an af. fidavit of the facts from Adviance, to be taken before Justice Ellet of Marysville, and a
warrant for the arrest of Shattuck to be issued, returnable before the Justice of the
Peace at Foster’s Bar.
On the following morning, I started for
Foster’s Bar with the warrant in my pocket.
'Adriance was to follow immediately [arrived there about the middle of the afternoon
of the 3d day of July, saw the Justice at that
iplace, Mr O. P. Stidger, immediately after
my arrival, and had him deputize a consta>
ble to serve the warrant. Jno. S. Stidger. a
brother of the Justice, and Dr. J. B Trask,

On the morning of the 4th, they proceeded in the discharge of their duties, and arrested Shattuck at Winslow Bar, in the midst
of a crowd, who had assembled there to
commemorate the birth day of our country.
They brought him to Foster's about 4 o’clock
in the afternoon of the 4th. A large crowd
had assembled at the Justice’s office to see
the murderer, ard, as many of us supposed,
to Lynch him, but after viewing the man
and hearing hm converse, almost every one
left, feeling satisfied that Shattuck was no
murderer. I heard many make the remark,
“If that mun is a murderer, then so are all
men, or words of similar iniport.
Adriance had rot yet arrived, and as he
was the prosecuting witness and the only
one who could give any evidence concerning
the matter, the Justice-announced that the
hearing of,thé case would be postponed until 4 o’clock the next day, and that the prisoner should remain in. the custody of the
constables.
Shattuck conversed freely with everybody
a reference to the charge xgainst him, giving a detailed and succinet account of all
matters, connected with himself, Adriance
and Dascher, and frequeutly said that Dascher was then either at Rich Baron Feather

. Adriance did not come on the 5th nor 6th
'On the 7th the Jusiice issued a subpoena
for bim, and depnted Henry Haddon to serve
it. Haddon proceeded to Marysville, found
Adriance, and on the 8th they arrived at
Foster's about 4 o'clock p.m. As they de
scended the hill to the town, they were rec
ognized aug soon almest everybody residing
there congregated at the Justice’s office, all
being anxious to witness the meeting between the accused and accuser. When Adri.
ance arrived, Shattuck was sitting in the
[Justice's office. Qn seeing Adriance, Shattuck arose, stepped forward te meet and held

as he did so—‘How are you, Henry?” To
whieh Adriance replied, taking Shattuck be

more than one-third of the exports of the .
State yearly, is made up of negroes. Most
of the slaves are in Eastern Virginia, and .
from 1815 to 1845, that part of the State .

the District Court of the 14th Judicial District of the
State of California. in and iGr the county of Nevada,
against Isane Fowler. Tho’s O’Brien. G. Yah Vrankén,
Eber Van Vranken and Jno. R. Evans, and in favor of
the Middle Yiiba Canal and Water Company, for the
sum of sixteen hutidted and sixty-two 45-100 dollars;
