Daughter, to Contest the Will.

On November 1,1890, William Whartenby,
a California pioneer and mine owner of Nevada county, who long lived at the corner
of Franklin and Jackson streets, made a
will in Philadelphia, where he was visiting,
and a little later he died.
He left an estate here and in Philadelphia
valued at $250,000, most of it consisting of’
houses and_lots-in this.city. By the terms
of the will he bequeathed to-his daughter,
Hannah W. McClure, wife of Penuel McClure, who lived at the Pleasanton Hotel,
$50,000. To one son of Mrs. -McClure;
James Whartenby McClure, he bequeathed 4 .
$25,000, and to Mrs. Mo(‘lure’s other sony}:
William Seward McClure, $20,000.
This total of $95,000 was all he gave to
his immediate heirs. The.remainder’he bewho received bequests was Mrs. Albania
Whartenby, widow:of the late James Whartenby, the millionaire of this city, and her,
daughter, Miss A. M, Whartenby, who arrived bere a few days ago and are now at
the Palace Hotel. They were given $20,000
each.
On their arrival here it -was stated that
they have been making a tour of the world
and merely wanted to see San. Francisco
again before returning. to Philadelphia,
which is their home. Later it developed
that they came to defeat, if possible, a contest of William Whartenby’s will. This contest has already been begun in Philadelphia,
avhere some of the property is, and the fight
is to be continued here, Z
Mrs. McClure and her two sons are the
contestants. They claim that Mr. Whar__tonby was not altogether possageed of his . °
faculties when he made the . Thus, they
claim, they have been kept out of “what is
properly their own. :
The two brothers, William and James
among: the best known of California pioneers.
‘Both early became possessed of fortuges, but
James was the more thrifty, and» when he
died his estate was estimated at considerably
over $1,000,000. He owned a large amount
of valuable improved city property. .Easton
& Eldridge at one auction sale disposed
of over $400,000 worth. The sales o: some
ofthe particular properties were uot confirmed, and the widow and daughter, now
hhere in connection with the other estate,
-yet-possess them. Among these properties
is.an improved lot at the southwest corner
of Polk and Turk streets which sold for
$96,350. Another lot, at the southeast corat $47,000.
When it became known that-Mrs. Albania
Wharte:.by and her daughter had arrived
‘here, there was~arumor--that they were
about to contest the will. This was quickly
shown to be anerror. There wag,no reason,
why they should do so, and their attorney
Sydney V. Smith, said that they would not,
and that he considered the will a fair one.
He stated, however, that the contest had already began in Philadelphia.
Mrs. McClure cannot understand why
Mrs. Whartenby and her daughter should
be beneficiaries of her father’s will. The
claim of undue influence is also put forth regarding the other beneficiaries, most of
-whomh live in Philadelphia, and who, by the
will, would receive from-$10,000 to $20,000
-each.
Mrs. Whartenby, when seen yesterday,
-would*say nothing about the forthcoming
contest, but it is stated che case will come
.up in the courts in the next few days, in.
connection with the probating of the will. of
William Whartenby.
Noone, except Attorney Sydney Smith,
appears to have known until yesterday that
the contest over the fortune of the old Californian bad been begun in Philadelphia.
They were surprised when they heard that
