Blood on the Moon.
Blood, Iago, blood! This was about the
condition of affairs at the Osborn Hill mine,
Sunday evoning, according to newspaper
riports from that quarter. A teamster was
sapped bya miner, Teamster rushed to
his home, thrust a revolver into his pistol
pocket, shouldered a double~barreled shotgun, filled his eyes with fire, and his gullet
with whiskey, we suppose, and sallied forth
to everlastingly perforate his’ assailant.
But when he got there the villain -had fled
and the teamster concluded to yo to bed.
It was a very happy ending of what but'a
short time before threatened to be a tragedy
most terrible.

' The Supreme Court of Connecticut, by a
unanimous decree, has eéatablished an’ extraordinary precedent in murder cases. It
is nothing more nor less thah the setting
aside of the old, common law precept ot
“once in jeopardy operates as a bar against
being placed in jeopardy again for the same
offense.” The case at bar was an appeal
to the Supreme Court against a verdict of
The common law objection was offered to
the appeal. But the court overruled it and
ordered a retrial. The main argument in
the decision is tbe point that ‘‘the old. English common law was.so cruel that judges
ter a jury acquittal, could fot be put in
jeopardy a second time for the same offense;
but, now that the old law has been relaxed,
a criminal ought not to benefit by the former practice and justice be thwarted of
judicial ruling.” 1f this precedent could
have been established in this State’ in years
past, many an offender who has gone unwhipped of justice would have

Died at Pomona.
Benjamin Franklin ’-Harris, formerly of
Grass Valley, and who will be remembered
by many of’our citizens, died at Pomona on
Friday last. Deceased conducted a cronk
beer factory at Grass Valley some years ago,
afterwards runuing a hack, and later owned
the bus line between Nevada City and
Grass Valley. At one time he was Marshal
of the latter place. Death was catsed from
paralysis. -Deceased was a member of
Golden Star Lodge, I. O. O. F, of Grass
Valley.

store, Mill street, where he will keep a
