The Prosecution’s Theory of the Murder Committed by Richard Phelan. The Enterprise says: According to the theory of the prosecution, the killing of Dan O'Connor by Richard Phelan, which led to the latter being convicted this week of murder in the second degree, was one of the most deliberate that was ever perpetrated in Sierra county. The evidence, although almost entirely circumstantial, showed that Phelan deliberately waylaid and shot his victim from ambush. The facts*briefly stated, which were proven at the trial, are that the Hilda mining company in Nevada county that Phelan was superintendent for was indebted to O’Connor ; that O’Connor had brought suit against.°the company and _ was @)out to: force the same to trial and compel Phelan to testify for him against the company; that on the morning of the killing Phelan met O’Connor near Sierra City and was _ informed that he would be. called’ upon to go to Graniteville as a witness, and that Phelan went back to the mine, armed himself with two revolvers and rifle, and securing one of his old empiloyes, Jesse O’Connor, to accompany him with a double barreled shot gun, ‘went down to the forks of the road and trail, laid in ambush and deliberately shot O’Connor down as he was going back to his cabin at Milton; that thereafter Phelan assisted by Jesse O’Connor moved the body into the wagonrut and endeavered to run Sam Devine’s ‘wagon over the body of O’Connor with a design to crush dut the evidence of the bullet wound. Failing in that he took the pistol of deceased from his pocket, (it was a Smith & Wesson), and finding no cartridges in it took some out of the beit that-he wore (Winchester; 88-iong), whittled oif the ends so, they would go into O’Connor’s pistol, fired three shots out of the revolver and then went to Sierra City and gave himself up to the authorities, after remaining around the body fully twoand one-half hours preparing for his defense. : Several witnesses were found by Phelan who were willing to testify that O’Connor had threatened Phelan’s life, . and one, Mr. Zuver of Auburn, told a wild and wooly story about deceased having blown up the cabin of Phelan sometime in June, 1896. But it was of no avail; Guilt. was stamped too plainly upon the face of Phelan. Ai Carter & Johnston's. d18 TALK OP STOPPING GAMBLING The Trustees Will Consider’ the Matter Next Monday Evening, Sheriff Getchell appeared: before the city trustees at their meeting last evening and stated there had been many complaints filed with him against the keno and round-the-table poker games ‘. now running'in this city: Hesaid District Attorney Riley had informed him that the games as.conducted here were not illegal, no commissions being held: out by the house. ~The city of Stockton recently passed an ordinance prohibiting even “social” keno, and was. enforcing it. The Sheriff thought that perhaps the best way tostop the games here was by ordinance, and the trustees concluded to meet.again next Monday evening for the purpose when all citizens who are interested in the subject are invited to éxpress their sentiments by petitions or otherwise. Marshal Tompkins said that many complaints were made to him because the games were running, but he could see no way of reaching them unless the trustees passed an ordinance. Officer Kilroy was present and was asked as to the charges being made that some of the saloons were infringing the midnight ordinance. He said that in certain cases the saloon men had elosed the front doors at twelve o’clock and the sports had continued to run their games in back rooms, barring him and other officers out. This information seemed to stir up the trustees considerably, and the sentiment was expressed that if any saloons in the future either directly or indirectly disregarded the midnight ordinance they will ve prosecuted. The report of the City Treasurer showed that the past month’s disbursements amounted to $737 01, leaving a balance in the treasury of $3,987 52.
