The Feeling in Favor of a Caucus Is
Growing.

SACRAMENTO, Feb. 11—The usual ballot for United States Senator was taken
this noon and with the usual result.
It has become quite apparent that no
Senator wili be elected this session unless a caucus is held, and while a majority of the two houses show no inclination to join in one there is a rapidly
crystalizing sentiment in the party
throughout the State that ome should
be called so as to settle the trouble.
Many of the Republican representatives are daily receiving letters from
their constituents urging them to make
a break in thisdirection. In the meantime the Democratic members are doiag their utmost to encourage the continuiance of the deadlock, as they see
in ita practical advantage to their
party.

Supposed to be a Crack
Sprinter in Disguise,
The man known as “Heyward” who
on last Fourth of July beat ont Phil R.
Bradley, Nevada county’s crackjack
sprinter, in a foot-race, and subsequently tried to arrange for a twenty
round fight at the same town with a
rancher from the lower part of the
county but was warned by Sheriff
Getchell to desist whereupon tbe event
was pulled off in Placer county and
proved a fake, is still swinging around
the circle. He recently showed up at.
Benicia as a soldier and made a match
with Billy Riley, Contra Costa county’s champion runner, Riley’s friends
bet $1,600 that he could beat “Heyward” ,
for one hundred yards. The latter won
handily by « yard in 10 ¥-6 seconds. It}
is now claimed by the sports who were .
dene up that “Hey ward” is J. A. Mayberry, the renowned Eastern sprinter.

The. Fall Summary of Attorney-General
Ford’s Recent Decision.
Attorney-General Tirey L. Ford has
furnished Adjutant-General Peeler an
epinion as to the standing of the National Guard of the State of California,
in answer’ to the following questions
asked by the Adjatant-General:
First—What. .is the legal present
standing of those members of. the National Guard who entered the service
of the United States in the SpanishAmerican way?
Second—W hat: is the legal status of
those members of the National Guard
who belonged to the companies of the
guard at the outbreak of the SpanishAmerican\war, but who did not enter
the United States service?
Third—What is the present status of
those companies of the National Guard
which volunteered and entered the
United States service and have since
been mustered out of such service?
Fourth—What is the present status
of those companies of the National
Guard which volunteered and entered
the United States service and have not
yet been mustered out of that service?
The Attorney-General in his: opinion
says:
:
“Those members of the National
Guard who entered the service of the
United States in the Spanish-American
war are not now members of the National Guard unless they have been readmitted to that organization in the
manner prescribed by law. If an entire company volunteered, leaving no
portion of such company behind, the
same rule would apply and such .company would thereupon cease to be a
component part of the National Guard.”
As to the second matter he says that
those members of the National Guard
who belonged to the companies. at the
outbreak of the war and did not enter
the service of the United States are
still members of the guard unless their
connection therewith has, been otherwise severed.
After quoting a number of sections
of the law bearing on the case, he says
that a National Guardsman enlists for
a specified time; that if he complies
with all the militaty requirements he
is entitled to certain exemptions; that
there is no express provision in the
law for the discharge of the companies
or the discharge of the men, except by
their own acts, other than the provisions contained in the Political Code;
and that there is uo express penalty or
forfeiture attached to any company for
having a membership of less than fifty
men. In view of this fact he is of the
opinion that the guardsmen cannot be
discharged from the service and deprived of their privilege of exemption
by mere implication, and without any
act of their own, before their term of
enlistment expires, which would be the
case, if, by reason of the membershtp
being reduced below fifty, the company
should be ipso facto disbanded. This
would be adding a penalty not provided
by the code. They are, therefore, still
members of the guard.
