The Government Sues the North Bloomfleld Company Under the Caminetti Act, Attorney-GeneralHarmon’ssuit to test the validity of the Caminetti Hydraulic Mining law and the constitutionality of the California Debris Commission was filed in the United States Circuit Court Thursday in the form of a bill in equity against the North Bloomfield Gravel Mining Company, The bill prays that the defendant company be compelled to file with the California Debris Commission a verified petition, setting’ forth every material fact concerning its mining operations, as required by the Hydraulic Mining law by filing a deed with the Debris Commissioners, surrendering to them the right. to determine how debris shall be impounded and disposed of, and how their mining ‘operations shall be conducted. The. North Bloomfield Company is the only one of the great hydraulic mining corporations that has failed to surrender its hydraulic apparatus to the supervision of Colonel George Mendell!, Colonel W,. H. H: Benyaurd and Major W. H. Heuer. ‘They deny that the Government has any right to interfere with their business, except in cases where there is a showing“that their hydraulic operations have been conducted so that flow between States. The North Bloomfield Company recently contest wherein the Government sought to draulic machinery, alleging that such operations were injurious to navigable rivers. The plaintiff effect that the North Bloomfield Company be prohibited from mining until it complies with every provision of the law, There are no allegations that the operaare an injury to the streams adjacent to the mines, -The new law confers the powers of supervision on the Debris Commissioners, irrespective of the question of damage to the navigable rivers of the State, They are given power to supervise the specifications, plans and methods of mining pursued by all companies engaged in hydraulic work, The law is based on the principle that the Government not only has the right to stop work. that damages interstate rivers and navigable streams, but that it has the right, also, to prevent the possibility of such injury by supervising the general operations of such companies, The Attorney-General’s instructions to the District Attorney are to push: the case with all possible vigor, The mining company will carry the case to the courts of last resort if.defeated below, -e ee The Ball Tonight.
