THE DAILY TRANSCRIPT Brown & Calkins, Publishers. THURSDAY saa ces MARCH 15, 1894. AN IMPORTANT DECISION, Supervisors Have No Power to Transfer Certain Money to a Road Fund. The Supreme Court of this State has ren‘ dered a decisicn that puts a limitation upon the power of Supervisors in the matter of roads, The facts of the case were as follows: There was due a road overseer the sum of $2,046 for work and labor done and fer money expended by him for his read district. There was no money in the road district fund and $496.61 in the general road fund ef the c unty, . A tax of 40 conts on each $100 of taxable property in the county had been duly levied, but the money received therefrom hid all been expended for road purposes, ‘ The Board of Supervisors made an order that the County Treasurer transfer from the general fund of the county to the} road district fund the sum of $1,552.62 for th: purpose of paying the indebtedness due the road overseer. Demand.-was;-made_upon_the Treasurer . that he obey the order of the Board and make the trausfer from the general fund to the road fund, but he refused to-do so and suit was brought to — him~ to make _-guch_transfer,-—____d The Supreme Court, ateer ing the sections of the Code of the County Government Act which were claimed te bear en the situation, said : “Tt is clear from the foregoing provisions "cf the Code that all the money which can be used for road purposes, with a single exseption, must come from the road poll tax and a preperty. tax of 40 cents on each $100 of assessed property, and that all contracts made and liabilities incurred in excess of the estimated receipts, are vvid. “In the excepted instance, the Supervisors are permitted by a two-thirds vote to order a portion of the cost of constructing bridges to be paid out of the county general fund. But this case does not come within the exception. “This being so, and assuming the petitioner’s claim to be valid, it is clear that the Board had no authority to pay it with money taken from the general fund, the rule being that public moneys can be used only for the purposes aud in the manner prescribed by law.” The Court held the Board had no authority-to-order the Treasurer to transfer money . _ from the general to the road fund, and that the Treasurer did right in refusing to make the transfer. Both, on the Coast. It is an interesting fact which seems to have escaped notice, although it has no political significance, that he taipablian candidates for President and Vice President in thelast campaign—Harrison and Reid—are both sojourning in this State at present, and what is more; near neighbors, the former being law professor ef Stanford University, and the latter is the guest of his father-inlaw, D. Martin. —-— = Superintendent Chas. Stokes of Grass Valley made a visit to the county seat to day. A County Sheriff. This is the title of the piece with which the Hosmer-Ross Dramatic Company —will open at Nevada Theater on Monday evening next. It has: been received with great success throughout the East.and is said to be a highly interesting play. The Hosmer-Ross Company‘are well up in the piece and will put it on in first-class style. This will be the first entertainment at the Theater since its recent renovation and improvement. Smith Released on Bail. George Smith, who was held to answer for the killing of Louis Francois at Grass Valley, gave bail today in the sum of $5,000 and ‘was discharged from custody. The sureties on the bond are J. M. Smith, Cal. R. Clarke, James Hennessey, George A. Cooper, F. L. Vooper and E. J. Rector. * Governor's Opinion. At a recent hisinane: convention in “the State of Missouri Governor Francis said: Each year the local paper gives from $500 to $5,000 in lines to the community in which it is located. No other agency can or will do this, The editor, in proportion to his means, does more_for his own town than any other ten men, and all in fairness with men he ought to be eupported—not because you like him or admire his writings, but because the local paper. is the best investment a community can have as a teacher or preacher. Understand me, I do not mean mentally or merally, but financially, and yet on the moral question you will find most of the 1ocal papers on the right side. Today the editors of the home papers do the most for the least money of any people on the face uf the earth.” For the Orphans. The Sisters of Mercy of Grass Valley have been soliciting aid to enable them to provide La. suitable Chapel which will accommodate the increasing number of orphans. They earnestly ask all those who feel interested to come forward and contribute. according to their means, for such an undertaking is well calculated to enlist the help of all Glasses, no matter what their creed or denominaton. To givé tothe orphan is but “to lend to the Almighty,” or in other words to put your money out at a very great‘interest. The Sisters gratefully acknowledge the prempt_and_ willing response made by so many kind friends wh‘ch has . placed them in a position to commence the noble work. Little more: remains to be done, but for this little the Sisters rely on the help of the charitable public, to whom they new appeal for assistance to enable them to bring the undertaking to a B“The Board of City Trustees hold their regular meeting tonight.
