Owing to the lack of funds the United States Judgss of that district have given the District Attorney to understand that he must not push the. cases now on hand. until another appropriation has been received. For that reason, and also because the Dis~ trist Atterney-is in-deabt-as to -hisright to} proceed in the manner proposed by the AntiDebris Association, he declined to order the warrants, but agreed to lay the matter before Attorney-General Olney for his decision. Mr. Boyd then went before United States Commissioner Heacock and swore to a complaint against the two Chinese charging them with the violation of law already stated. Attorneys and mining men who are familjar with the Caminetti law assert that there is only one way to proceed in cases of violation. That it is not a question of law but one of facts tobe determined. A complaint w leging that debris is being washed into a navigable stream must first be referred to the California Debris Commission. If the Commission finds the complaint well found. ed it must ask the United States Attorney te begin action against the offeader. The Commission is composed of Government engineers, who are thoroughly familiar with the rivers and harbors in the State. They will know if the streams are being injured and suits brought upon their recemmendation will save the Government the expenditure of large sums in useless litigation.
