Of intention Necessary To Be Passed
By the Board of Trustees.
WHEREAS, Application has been made fora
franchise to erect and. maintain poles, wires
and other conductors for the tr nsmission of
electricity for telephone and telegraph purores in and upon the streets, alleys and pubfie highways in the city of Nevada, and to exercise the privilege of operating telephones
within the said city, for a term of twenty-five
(25) yers; and .
/HEREAS. It is proposed to grant the same to
the nighest bidder, in the manner prescribed
by law.
“Now, THEREFORE, BEIT RESOLVED, That the
City Clerk be and he is hereby instructed to advertise in the DAILY TRANSCRIPT, 8 newspaper
ublished in the city of Nevada, State of Caliornia, for ten (10) consecutive days, the following notice of intention to award a Franchise
granting the uforesaid privileges to the highest
bidder; in the following words, to-wit:
NOTICE OF SALE OF FRANCHISE.
Notice is hereby given that the Board ‘of
Trustees of the pe J of Nevada, Courtty of Nevada, State of California, has received application for a Francise to construct, lay down, operate and mai:.tain an electric telephone and
telegraph plant and system, wita all the necessary appliances, in the public streets of the
City of Nevada, for the period of twenty-five

Board of Trustees will on: the 20th day of November, 1804, at 8o’clck P M., meetin the
City Hall of the City of Nevada, in open session,
for the purpose of opening sealed proposals for
the purchase of a Franchise of the chsracter
and for the term set forth below, at which time
and place said Franchise will be awarded to
the highest bidder. The following is a ly

passed awarding to the successful bidder the

SEcTION 1. The City of Nevada hereby

city, poles, wires and other conductors for the
transmission of electricity for telephone and
telegraph porponye.
SECTION 2, Such wires or conductors shall be
stretched upon poles or other fixtures above
ground in a workmanlike and pg rd manner;
said poles shall be erected at the edge of the
sidewalks in said City in a good and substintial
manner and shail be painted. Said grantee and
its agsigus shal) cause a wire to be placed in the
ey Hall of said City with @ proper receiver
and transmitter, which er shall->keep in good
condition and which thali be open to use of the
City Marsha!, or other City Officers at all times,
for police or fire alarm purposes, free of charge.
Che Board of Trustees of said City. shall have
the right to cause said grantee to move the lo
cation of any pole whenever the publie convenience shall require the locatiou of the same
elsewhere; the expense of such removal to be
paid by said grantee,
SECTION 3. The said grantee, or assigns, may
make all necessary excavations in any of said
strects, alleys or public highways for the purpose
of erecting aad maiotainine poles or other supports’ for said wires or conductors or repairing
the sam», and said work shall be done in com-—
pliance with the necessary rules, regulations,
curdinances or orders whic may, during the
continuance of this Franchise. be adopted from
time to time by the Board of Trustees of said
City, and the same shall be done to the satisfaction of the said Board of Trustees.
SECTION 4. Nothing in this ordinance shall
be construed asin anywise to prevent the proper
authorities of said City of Nevada from sewering, grading, paving, rope repairing or a}
tering any of said streets or thoroughfares herein mentioned.

herein granted the said City of Nevada shall
have the right to suspend and maintain upon
the poles: placed by said grantee, its successors
or assigns, iu the streets and thorough far: s aforesaid, any and al: wires which sai city may require for fire alarm and Police Telegraph Service, free of charge t> said City.
SECTION 6 . The rights, privileges and franchises herein granted shall continue and be in
force for the period of twenty-five (25) years
