Some Circumstances That Warrant Further Investigation Being Made.
The indicting of Richard Phelan of
the Hilda mine of this county by the
Grand Jury of Sierra county is not a
surprise. Phelan claims that he killed
Dan O’Connor in self-defense, and will
at his trial introduce the evidence of a
large number of witnesses (including . Lizzie York of, Downieville were in
the numerous Kane family of Sierra . town last night on their way home from
City) who will testify that O’Connor . Downieville. :
had not only frequéntly threatened to
take Phelan’s life at the first opportunity, but had borrowed a riflelwith the . ;
with it and had been seen loitering
with a gun around theatter’s house at
midnight apparently waiting for a
chance to assassinate him. To counteract. this, however, is the fact that
while Phelan says he shot O’Connor in
a face to face conflict in a duel where
the latter was the aggressor, an examination of the scene of the shouting
taken in connection with the nature of
the wound give reasonable grounds for
suspecting that O’Connor was shot
from ambush just after he had passed
the hiding place of the man who was
lying in wait for him.
brought out so far a conviction will be
obtained; but the circumstances of the
_ bloody affair are shrouded with about
so much mystery that District Attorcaring through the Grand Jury’s intervention a searching and careful investigation of the circumstances such
as a trial in the Superior Court will atford.

THE CHAYANNE BSTATE.
Valued at Over $40,000—The Widow
Files the Will. ;
The will of the late Andrew Chavange
was filed in the Superior Court today
together with a petition for probate.
The petitioner is Emelie Antoinette
. Ohavanne, the widow and the sole heir
of the deceased. The will is an olographic one, being entirely written,
_ dated and signed by the hand of the
testator himself. There are no subscribing witnesses. It was executed
on June 18, 1895, at which time Mr.
Chavanne was over seventy years of
age.
The only other living relation that is
next of kin, as far as the widow knows,
is Jean Marie Chavanne, the son of a
deceased brother of the testator. He
was born in New York, but bis present
place of residence is unknown.
The total value of the estate is estimated to exceed $10,000. It consists of
an interest in the Independence quartz
mine of Grass Valley; real estate on
Eddy street,San Francisco; 4000 shares
_of stock in the Minnie quartzclaim and
-2000 in the Watt Blue Gravel mine.

Struck Good" Gravel.
G. W. Maybery, who has been prosypocting on the Washingion ridge for .
ten years past, came down today from
his drift claim near the Central House.
He has the tunnel in 442 feet. This
week he struck the vein rock and got
some splendid prospects of course
gold. This winter Mr. Maybery will
give his personal attention to the working of his gravel claim near Folsom
and in the Spring will return and push
the tunnel ahead in his Nevada county
elaim. For sometime past he has been
running over a break, but everything
in licates that he. will soon be in the
muint channel. Mr. Maybery is’ over
seventy years old, but he has enough
ambition and energy to open several
mines yet. ° 2ee>
